no, the logic is that it doesn't require a license to drive one....



and I think if you are drunk and running people off of sidewalks or impeding traffic (which can cause an accident if someone swerves to avoid you), then there should be some sort of punishment. But losing your drivers license does not seem appropriate to me

General Statute 20-4.01 doesn't care what your outdated DOT Bicycle Laws handbook says and neither will the cop.

This was just added within the last three years or so. I'm sure you could find an article on WRAL if you searched.

geeze people calm down

i was just pointing out that it sucks that no one bothered to update the BIKE LAWS HANDBOOK to mention that its ILLEGAL to bike while impaired, and in fact it says that bikes aren't considered vehicles for that purpose in that very handbook

i don't think the DWI bike law is as much to protect other people as it is to protect the idiots riding drunk on a bike, it seems like there is a serious problem with enforcement of bike laws and general lack of awareness about bicyclists and their rights among drivers... so i say its to each his own, don't be stupid and ride drunk

I disagree. There are already public intoxication laws that are supposedly in place to protect those who might hurt themselves. Applying DWI laws to cyclists is just overstepping rational bounds.

I asked a VA cop once about bike dui's and he said the sidewalk was fine, just don't be in the road. Though, I'm sure they'll make it work for their case somehow if they wanted to.

i dont have a problem with bikes in the roads in the city or where the speed limit is 30 mph or below and there are tons of traffic lights anyway

but if you are on a major road with few lights thats 35 and up use the sidewalk

You've got to be a real drunk jerk to get a DUI for some late-night bicycle shenanigans at a beach resort.

That said, the Sunset Beach police are kind of intense.
