Sure it is:
Put Op on the stand..
DA: Did the defendant admit to taking pictures of you? OP: Yes
Put the Defendant on the stand...
Defense: Did you admit to taking pictures of your accuser? Defendant: No.
Could you charge the kid? Sure could. But, why? There are plenty of times that I find myself meeting the elements of the crime but realize that in court, it won't hold water.
Also, to charge a juvenile, you file a petition and the majority of them never get filed and set for trial because the minor doesn't have a record or the charge isn't that serious. Its like saying, hey look what I found, you think we should proceed type deal. Its a colossal waste of time. 10/22/2012 6:26:15 PM |

I'm pretty much in the "let it go" camp, but to be honest, I'd consider calling Child Protective Services and making sure they were aware of the situation. You're right in thinking that the weirdest thing about this story was the (non) reaction by the parents. This is the sort of situation that a lawsuit isn't going to do a damn thing, but you'd like to think that the parents will at least make sure it doesn't happen again. From the way you described it, it sounds like it was a fairly routine thing in their family. 10/22/2012 7:35:00 PM |

dude, in another 10 years you'll be paying a stranger to stick his finger up your butt. is it really such a big deal that some sexually confused teenager snapped a picture of your dick?
who has time for this shit? move on

Wow, my first take after reading the OP was that you over reacted. I mean really you're trying to press charges? WTF. Did he take a picture of you with your panties on or something?
Personally I would have chased him down just to scare him a bit and make him think about the stupid shit he just did. But I don't think I would have went as far as wasting two hours and dicking around with the police. 10/22/2012 11:04:56 PM |

if a stranger came out of a restroom physically restraining my child, as a parent I would automatically move to protect my child. the fact that the family didn't respond to this throws up a shit ton of red flags. The kid needs help. I would call child protective services (or someone similar?) and inform them of the whole situation. 10/23/2012 12:11:24 AM |

I feel sorrier for the kid than the OP
He's obviously fucked up/sexually confused, and now he's been humiliated (and rightfully so) and shamed to hell in front of lots of people.
this will probably haunt him for life. somehow, i think the OP will survive 10/23/2012 1:26:03 AM |

Something tells me the kid got the shit beaten out of him by the dad once they got home from the fair. I wouldn't put a lot of effort into pressing charges if they don't recover any photos. At that point it's just he said she said.10/23/2012 7:03:58 AM |

\/ Whoops. I stand corrected.
And this is a child who will learn from the reaction to this situation. He committed a crime and deserves punishment for his actions. If he deserves leniency that's not your decision to make.
He should count himself lucky that he was caught by someone who could show enough restraint to do what is right. His chances of doing this to some dude who would rather beat his teeth out are pretty high at the state fair

I feel like at this point I'm probably in the let it go camp. I do agree though that the parents reaction changes the situation a little. If it had been me I probably would have done the same as far as running out and grabbing the kid and hauling him off to his parents expecting them to shame him and yell and apologize or something. Either that or I simply would have taken the phone and tossed it in the toilet and said there we are even and gone about my business. 10/23/2012 9:29:45 AM |

that's what I tell all victims of a sexual crime. Would you say the same if the kid was taking pictures of naked women? what if the kid was older, say 16? 22? where do you draw your lines?10/24/2012 1:52:52 PM |

i know we're getting off subject, but the vast majority of 14-yr old kids aren't done growing. I find it pretty ludicrous that you're trying to argue that. Holy shit, I'd have probably posed for the damn camera if I saw that. At most grabbed the kid and handed him over to his parents, but getting the cops involved?
Then again he needs to learn a lesson before he gets caught by the wrong person, and it's a 50/50 shot these days on whether "parents" will do any real parenting. Kid's 14 and curious/confused/worried about how is own kid-wang measures up, I wouldn't ruin his life over it.
Upon further reflection, you probably did the right thing. I just don't think I'd have taken it that far, maybe let his redneck dad beat the snot out of him and let him grow up a twisted killer and end up in an ID Discovery documentary in a couple decades

plenty of full-grown kids in middle-school? ok, gotcha, must be all the hormones in the milk these days. I'm just glad they weren't at my middle-school, or smear-the-queer and full-contact basketball would have been a lot more dangerous. I was probably about 5 feet tall, like most of my friends.

I was 5'11 by the time I was 15 and had to start shaving shortly thereafter.

Good to turn him in, probably nothing big to worry about but better safe than sorry. And always remember no one ever gets busted the first time they do something.
And it doesn't matter when a kid goes through physical puberty. Their sexual identity and brain development is still going through massive change (not to mention hormonal changes) well into the late teens and early 20's 10/24/2012 9:27:32 PM |
