Went to Champs today, the waiter was completely incompetent. He came out and asked for our food and drink order twice b/c he forgot it. And it seemed like he was also drunk or high. Horrible service.

I did not give him a tip. Normally I'm a 20% tipper.

Yeah, but your argument is totally wrong.

There are lots of times when servers have a shitty shift and walk out after an 8+hr shift making like $50. It fucking sucks to run your ass off all day and have people stiff you left and right. Whatever you didn't make that day in tips, you'd better hope that the next shift makes up for some of it!

At least retail employees can get overtime for staying late. And their hourly wage never fluctuates.

I can deal with tipping waiters and pizza boys since I can do it on my credit card pretty easily.

What I can't stand is tipping every asshole I come in contact with at a nice hotel. Before the trip I have to make sure to take a bunch of $1s and $5s like I'm going to a strip club, which is a pain in the ass

I get exactly what you are saying. If you get a paycheck at the end of your 2 weeks it plus your tips must come out above minimum wage/hour. If it doesn't you are obligated to be paid the difference, period. If it averages out you're fine.

Ultimately I'm gonna drop it here because we both are gonna argue we're right. I just don't like this bullshit moral imperative argument that gets raised. I just want someone to admit that they like taking bribes because it is good for them most of the time and they want to keep it that way. And it is a bribe even though it occurs after the fact because it impacts what you or someone who looks (black people) or acts like you gets for what should be an equal service.

Who enforces the thing where the employer is supposed to make up the difference if the tips don't add up to minimum wage?

It sounds like to actually get the extra money when the tips are not adequate the employee would have to ask for it (kind of shitty...no one else has to ask for their paycheck) or complain on their employer to some government agency, neither of which are good options when you are at risk of getting singled out for firing, bad shifts, scrubbing the shitters, etc....

I wish the waiters were paid at least minimum wage and the tips were split between the waiter and the kitchen staff. I have a lot more problems with fucked up food or food taking too long in restaurants than bad service. When the kitchen is fucking up I don't stiff my server, but I bet a lot of folks do.

Right now, Steve averages three large tables a week where the automatic gratuity averages $70/table. That $210 goes into his pocket and he pays taxes to the IRS and state himself. After the new rule kicks in, that $210 is no longer considered a tip but is now deemed to be part of Steve’s wages, more than doubling the base pay the restaurant had been figuring previously. And what happens when there’s a dry spell and those big tables dwindle down to only one per week? Now the restaurant is figuring yet another hourly wage for Steve. Darden Restaurants, better known as the parent company of Olive Garden, Red Lobster, LongHorn Steakhouse, normally adds an 18% automatic gratuity for parties of 8 or more, but recently dropped that policy at restaurants in four cities in advance of the IRS rule change, and to test a new system that calculates and suggests tip amounts of 15%, 18%, and 20% for groups of all sizes. Likewise, the folks at Texas Roadhouse are getting rid of their 15% auto-tip for parties of 8 or more. “I don’t want my tips to be on my paycheck as a wage. Bartending money bought my first house and paid for my law school loans. Kept me afloat while I started my own practice. Probably was at least half of the funds used to start my first restaurant.

So yesterday was my brother's last day at his waiting job....he quit to take a different job

He texted my mom and me a photo of a bill that was $198 with a $5 bill beside it. Damn. He said they were all excited for him about his next job (I guess they talked a lot to even know that) and they hugged him and said good luck on your new job on their way out.

We were hoping so hard that it wasn't a black family.....it was .
