Its not unfortunate. Unfortunate implies there was some bad fate or chance that landed him in this position.

Well then, y'all tell me if this is BS or not.
Last month, I was leaving a bday party and fell into a total police trap on my bike. As soon as I got on the bike, they pulled me over and starting questioning me. So, obviously I am a foreigner here, and I was not familiar with what the rules are in Germany and what the limits were for a bike. These cops were all older than 30 and hence their English was nonexistent, so we went along with German. They asked me if I wanted to blow or take a blood test, at which point I asked them what the difference was between the two. They say that there is no difference and that I must decide. So, I say blood test (because who and the fuck would take a breath test and trust the cops with that in the States) and then we head out on our way, and they seem unaffected by it. They did not cuff me, took me to the station and asked me where I was from and we started to chat, and it was no big deal. By this point it became apparent to everybody that I was not that drunk or intoxicated, and we started to just chat in the police station as they assured me that nothing would happen with my visa or such, and then one guy went into a long boring story about Arizona that I happily smiled along with. So, I take the test, they say nice to meet you and what not and then I leave and am on my way.
The following week I get this very confusing bill in the mail from the blood test result. It stated that even though I was under the limit for riding a bike, since I insisted on taking a blood test I still had to pay a fine. I then complained a little about it at work and all the Germans laughed at me because apparently it is common knowledge that you always take the breath first, and then if the breath is too high you proceed for a blood test to verify how high the level is. Aint that some shit?

So it's BS right? If they had just told me that if I blew too high that we go to the blood test anyways to confirm, I would have puffed all over that thing like Monica on Bill, and then I would have been able to just go on my way.

Normally the breathalyzer goes down as a result regardless if it is accurate or not. I know that in Texas at least, it was possible for it to be faulty and then you are screwed cause it registers as such on your record. Here, the lower of the two tests goes down on the record.
Plus, whether that was a dumb move or not, the point is that I asked them to explain the rules to me several times and they deliberately misled me. 9/24/2014 8:26:05 AM |

the breathalyzer is a field screening device only, if you fail the one in the field they take you to the station for the larger, calibrated, desktop model that is the one that can be used in court or you get a blood test. 9/24/2014 9:51:23 AM |

The issue with the field breathalyzers (in NC) is they generally do not hold up in court. They can be used to establish cause for a DWI arrest, but the measurement used in court it the big intoxylyzer 5000 at the jail.
Defense attorneys ask for all the calibration records and challenge the evidence and the portable units do not stand up. I knew a guy in high school that got an underage DWI (blew under legal limit beside road, but was underage) and it was all thrown out because the cop just gave him a ticket and made somebody pick him up. He did not actually take him downtown for a breath test on the machine.
The bus they bring to roadblocks does have the big breathalyzer on it though, so you lose out on the time to come down between being arrested and tested at the jail. 9/26/2014 1:01:20 AM |

You will not be convicted of DWI if they can not prove you were intoxicated at the time you were driving.
DWI is a misdemeanor, hit and run can be a felony if there are injuries.
