see, that's why there's just way too much reasonable doubt. and if he gets convicted I hope it gets overturned on appeal
Quote : | " Honestly, I don't know if he did it or not, but, as a citizen, I could in no way convict this guy based on the inadequate evidence presented by the prosecuting attorneys. I find the overwhelming nature of those in this thread to convict the man, without any real evidence, to be a fine representation of what is wrong with our legal system." |
I agree. I might have "theories" but they are just that. I would never convict someone based this "evidence"

I think i remember reading something about her sister(twin?) or something dressing up like the murdered wife so the kids would feel more at home.

exactly. From the start the case against him was questionable at best. Now that the trial is on, and there really isn't any evidence pointing to him, I think he's gonna get acquitted. However, since the majority of the population is dumbfuck retarded, I wouldn't be very surprised if the jury convicted him.
I've actually read the golo comments posted in the latest story, and the majority of them are starting to think he's not guilty, which is a change from when it all began. 3/24/2011 5:05:18 PM |

Based on what i've read so far, i'm surprised this even went to trial. Prosecutors don't like losing high profile cases and unless they are waiting to unveil a bombshell, this one is a sure loss. How did they ever think they had enough evidence to convict...on the contrary, they don't have any real evidence at all. 3/24/2011 5:22:05 PM |

^3 I think since it was such a high profile case they just went with the odds on this one. They chose to lock him up and force a guilty plea or eventually find they evidence that they need. Neither one of those things happened and now they have to work with what they've got, which isn't much. 3/24/2011 6:43:01 PM |

No doubt in my mind that this dude walks now.
The prosecution has not shown one scrap of actual evidence that the guy had anything to do with his wife's murder. Every single thing they've brought up has been circumstantial at best.
And now with potential jury tampering, there's a real chance of a mistrial. The commenters at golo - not the best source, I know - say that the person tampering with the jurors is the Coopers' neighbor, who took the stand recently.
One guy even goes as far as to speculate that Nancy Cooper could have been banging one of the neighborhood husbands, prompting a jilted wife to kill her.
With the way her extramarital indiscretions have been glossed over by CPD and the media, I think that's entirely plausible, and that it's possible the CPD just took the "easy" way out to try and pin it on Cooper. You would think, however, that if the man had strangled her, and that if he were a suspect from the start, any Detective worth his salt would've immediately checked him out for defense wounds. There is virtually no way anyone would get strangled and not fight back. If he wasnt checked on the day they found the body, then CPD is terribly inept. 3/25/2011 11:01:53 AM |

Quote : | "Raleigh, N.C. — The presiding judge in the murder trial of Brad Cooper has asked the Wake County Sheriff's Office to investigate a possible case of juror misconduct.
Superior Court Judge Paul Gessner received an e-mail Friday morning about one of the jurors allegedly talking in public about the case.
"It does appear that it would be error on my part to ignore it at this point," he said.
Brad Cooper, 37, is on trial for first-degree murder in the July 12, 2008, death of his wife, Nancy Cooper, 34.
His defense attorney, Robert Trenkle, objected to Gessner's order, on the grounds that the e-mail is vague and "could serve to intimidate or chill the jurors" in violation of his client's rights.
"My primary concern is that I have repeatedly given these jurors instructions that they are not to talk about this matter among themselves or allow anybody to talk about it in their presence," Gessner said, "and I need to determine whether or not that has been violated."
Meanwhile, the trial continued Friday morning with an AT&T analyst testifying about cell phone records in the case.
Brad Cooper has said that Nancy Cooper went jogging the morning of her death and never returned home. Her body was found two days later in a drainage ditch about 3 miles from the Coopers' Cary home.
Defense attorneys have said Cary police work in the case was "inept" and "dishonest," because they disregarded evidence that didn't support their theory that Brad Cooper killed his wife." |

I agree. Based on what I've read. And obviously I haven't been there for any testimony. But just the media reports so far. No way I could vote to convict him
I'm 90% sure he did it based on gut feeling. But I've also read a few things that make me believe he didn't do it. I also get the feeling the family hated him so much they are doing their best to make him look like the biggest asshole ever. It seems as though they are cherry picking the bad moments and trying to use that against him. I also get the feeling Nancy was setting him up to look like an asshole for a pending custody hearing. Now the family is using that to try to get him convicted. 3/25/2011 11:10:25 AM |

two words for why I don't think this guy is guilty.
women complain.
Every guy here, and even many women, can acknowledge that if a woman doesn't get her way with something, and doesn't understand why, she will complain to any and everyone who is willing to listen to her vent She had buried her family in debt and Brad put on the chains and reel it in. She then complained to her neighbors about how she didn't have any money to get groceries and made him look like a monster. Meanwhile, Brad can't defend himself 1) because he is working and 2) because it wouldn't matter since she poisoned them against him anyways. Of course these people will get on the stand and say he did it; all they have heard are bad, negative, adulterous things. Their thoughts and opinions on the matter carry no weight and, since this guy isn't a criminal mastermind and strangling is a crime of passion, he would have left ample evidence in the short 12 hour turnaround from disappearance to police involvement.
If I were on that jury, I would vote the guy not guilty, without a doubt. 3/25/2011 3:27:01 PM |

"They have looked into the matter, and based upon their response that they have provided to me, there is no need for any further inquiry at this time," he said Friday afternoon. "I am satisfied that we're in a position to proceed based on their report."
He did not elaborate on the investigation." |
Quote : | "The state reviewed with detective Jim Young documents and papers that officers seized from the Cooper home during a July 16, 2008, search.
They included Nancy Cooper's Canadian passport, Social Security cards belonging to the Cooper children, articles about divorce and personal notes of Brad Cooper from a former girlfriend.
Gessner overruled an objection by defense attorneys to the personal notes taken from the closet of an upstairs office. They argued the notes from the mid-1990s before Brad Cooper met his wife and could prejudice the jury.
Wake County Assistant District Attorney Boz Zellinger argued that the fact that Brad Cooper still had the notes raised questions about his assertions to Young days earlier that the Coopers were working on their strained marriage." |

Quote : | "[Judge] Gessner, however, allowed the letters to go into evidence.
The defense, Gessner pointed out, has described the Cary police department as "inept" and "dishonest." In so doing, Gessner said, he opened the door for prosecutors to introduce evidence showing the thoroughness of their investigation." |

I think allowing the letters in is proving that. This police force is "inept" and "dishonest" and honed in on Brad Cooper from the beginning, and now they're showing 16 year old love letters to prove that. Seriously, how do old love letters found in a shoebox in a closet make it more likely that someone killed their wife?

Quote : | "Raleigh, N.C. — One of the lead detectives investigating the death of Nancy Cooper continued his testimony Monday in Brad Cooper's murder trial, reviewing evidence from the couple's house, as well as surveillance videos from the day before and day of her disappearance.
Detective Jim Young said investigators found a receipt in Brad Cooper's car from a Cary Lowe's home improvement store for an 8- by 12-foot plastic drop cloth. A surveillance video shows the purchase was made at 9:30 a.m. on July 11, 2008, the day before Nancy Cooper's death.
More Info Jim Young Full video: Day 13 trial testimony
That was about the same time, Young said, that Brad Cooper told him he was running late for work because he had been at home helping his wife with their two young daughters.
Five days later, investigators found what appeared to be an unopened drop cloth in a Home Depot bag beneath a workbench in Brad Cooper's garage.
By that time, Nancy Cooper, 34, had been reported missing when she failed to return home from a morning jog, and her body had found in an undeveloped subdivision several miles from her home.
Brad Cooper, 37, was arrested more than three months later and is standing trial for first-degree murder.
Young also testified Monday that cell phone records showed Nancy Cooper tried several times on July 11 to call her husband at work and that those calls were forwarded to his cell phone. One call went to voicemail, while two others went unanswered.
It wasn't until 2:32 p.m. that day that she was able to connect with Brad Cooper, Young said.
Brad Cooper's cell phone records also showed data usage at 6:25 a.m. on July 12, 2008. At 6:25 a.m., Young said, Brad Cooper was also in a Harris Teeter, several miles from his home, buying milk.
At one point in surveillance video, Young said, it appears that Brad Cooper is interacting with his cell phone before paying for the milk and again before he picks it up to leave the store.
Defense attorneys have said Brad Cooper went to the store to buy milk for the younger of the two Cooper children.
When he got home, they have said, his wife asked him to go back for laundry detergent, and while he was on his way, she called him to also pick up some juice.
Young said that Brad Cooper was wearing different shoes on each of those trips and noted that on the first trip, he "makes a motion as if he's wiping sweat from his brow" as he enters the store and then rubs his hand on the rear right side of his blue jeans.
Prosecutors say that Brad Cooper killed his wife sometime during the early-morning hours of July 12, 2008, and transported her body to a drainage ditch outside Cary's town limit, about 3 miles from their home.
His attorneys, however, say that their client didn't kill his wife and that Cary police ignored evidence that didn't support their "Brad-did-it theory."" |
