Now Det. Young is trying to foist his deletion of Nancy's Blackberry onto the AT&T rep he spoke with...the one whose name he didn't get and whose level of expertise he didn't know.

Detective Young is really, really good about 'answering' with non-answers.

For yes/no questions he goes on and on and on about other random crap.

I've noticed that as well. It's scary to think I could be put on trial for murder based on the detective "skills"of Detective Young. Hell, I almost think someone who watches SVU regularly could manage to screw less things up in an investigation.

I have been selling cell phones for two years....and anyone will fucking tell you if the password is entered wrong too many times the blackberry security wipes and any data on it is history....deliberately scrambled to the point its not decipherable.

The whole point of Blackberry devices is they are ridiculously secure, corporations/govt agencies want to know if any employee drops their phone in the airport proprietary information is not going to be uncovered or leaked. If she actually did have a password on her device that only she knew there was likely no way to get to it to begin with....she took that information to the grave.

Still the detective was stupid for fucking with it if he did not know what he was doing, he created an issue out of something that could have been a non-issue in the trial. The defense is going to say she had some boyfriend or something that wanted to hurt her....and they never had a chance to examine her cell phone data to see who she was in contact with due to the detective causing the device to wipe.

They have an argument, cell carriers can provide some data regarding SMS text messages, but blackberry messages or other instant message clients that can run on a smartphone are not retained by the carrier.

But you guys, it was the cell phone tech support that fucked up, not him! And he didn't bother calling tech support back because "you never get the same rep twice."

what gets to me the most is the fate of a person's life is in the hands of the Cary Police Department. Rather than admit they hastily arrested the guy, CPD is willing to send this guy to the slaughter to protect their own neck. in situations like this those who act as the voice of the law themselves become the murders

I am not sure exactly what he did but it sounds like he entered the wrong PW, thats the only thing that could trigger an unwanted wipe.....the phone tells you how many tries you have left, it remembers even if it is rebooted, 10 tries is the most it can be set for, however the user can set it for less.

You get huge warnings on the last few that it is about to wipe.

I have had customers pretty much have a mental breakdown because their little kid got ahold of their blackberry and kept pressing buttons triggering the security wipe.

paraben makes a few forensic tools for the blackberry, they could have gotten something or at the very least taken a memory image to work off of so they didn't have to worry about wiping it. its secure to the lay person, but i'd bet the right person could have gotten the information off of it.

He claimed that at&t told him to do one thing, that magically deleted the phone data without warning, and he didn't bother calling at&t back to see why that happened.

And really, who the hell hangs up on tech support before completing the technical task at hand?

Exactly, if he had not caused the wipe he could have handed the device image over to the defense and they would have no way to claim he destroyed evidence....even if nothing could have been extracted from it they would not have destroyed it.

You heard that correctly. Note that the search warrant was drawn up ~6 weeks after the phone was wiped.

I think the point was to say that the detectives never found the jewelry that was on her that night...however the prosecution never mentioned that. they did a terrible job.

they have really messed up this whole case...the CPD did bad enough.

"Detective Jim Young, who was one of two primary detectives assigned to the case, faced tough questions Wednesday from defense attorney Howard Kurtz about how he handled evidence in the case, specifically Nancy Cooper's password-protected BlackBerry smartphone from which he said he accidentally deleted data while trying to unlock it.

Young said he contacted the cellphone carrier, AT&T, to help him obtain access to Nancy Cooper's call history and a text message she had received on July 12, 2008.

He said he talked to an AT&T representative who told him he would need to go through a sequence of screens before entering a PIN unlock key (PUK) code.

It was more than a week later that he attempted to access the phone data based on what he remembered the instructions to be, Young said.

He was never prompted for the PUK code and, instead, was warned that the phone's data would be wiped from the device.

He proceeded, thinking "the PUK code request screen was forthcoming," he said.

Young said that he never tried to call AT&T to try to recover the data because the information he had sought was already contained in cellphone records."

I would think a homicide detective would have to have a better understanding of how cell phones work than this...also understand the importance of preserving evidence.

The device still warned him if he proceeded it would wipe the data, there is no way around that, he was wreck-less in continuing to enter the incorrect password.

Or maybe he got into the phone, saw some evidence that could have cleared Brad but said fuck it. We going after his ass, so he "accidentally" entered the passcode is wrong

there's something very sketch about someone being willfully stupid enough to keep entering a wrong password in to a device that says it will unequivocally destroy all the data if that use pattern continues

If I were on the jury I'd have to find Cooper not guilty just based on this cellphone bit alone. There is no way that someone is that fucking stupid. The device gives you multiple warnings and makes you jump through all sorts of hoops by DESIGN, and for him to casually neglect to mention that he had "accidentally" wiped the device in the search warrant really calls both his character and the prosecution's case into question.

If I were a higher up in the CPD, that detective would never work another shift in my department because he's either:

1. Stupid beyond all measure

or

2. Willfully disingenuous

my favorite is the last three tries where it makes you key in the word "blackberry" to ensure you are not just sitting on the keyboard or your phone fell in a baby crib.....he had to correctly enter the word blackberry three times before entering the wrong password the last three times and causing the device wipe

what gets me is that he got the information for the PUK code and how to operate it...then waited a WEEK to go through that process.

He didnt use any computer to dump the data, didnt send it to the FBI or even go to AT&T or the blackberry place thats right here in Raleigh.

All this and yet he still said today he had no idea what a SIM card is although he OWNS a blackberry and even knew the model number of it.

He intentionally did all that to the phone...he kept it in his desk for over a month, not in evidence and not in the electronics lab.

I hope Cooper sues the pants off of Cary PD.

its really quite humorous

I've been reading about the trial on websleuths and if you haven't heard of it, it's a ridiculous forum, and those people are idiots. agreed. totally agreed.

i was talking to someone about it today and i wanted to bang my head against the wall

they were like "here's my theory...the autopsy showed no food in her stomach, except what they think is an onion, but everyone said they saw her eat ribs and guacamole at the party the night before. i think she was bulimic. then they argued in the hallway. then she went and threw up. then they argued more. then brad suffocated her with a pillow. then to make sure she was dead, he strangled her"

the same person ALSO has been watching the trial nonstop and has taken the viewpoint that the CPD has done an amazing job, not at all inept, made no mistakes. also thinks the judge is amazing. i then heard like 4 more theories about how brad did it and left no physical evidence...in detail. i mean it is just the most ridiculous shit i've ever heard. anytime i tried to bring up the evidence question, she circumvented with another theory or an example of how she thought CPD handled the case SO well. i don't get how anyway halfway intelligent person, who is actually following the trial, could come up with the idiotic statements i heard today. but whatever.

the issue with your story was "she"

a lot of women are willing to convict this guy because he is a dude and they are secretly unhappy with their own lives.

Basically, this detective thought he was going to be the hero on a case that went national. realized he fucked up and tried to cover his tracks. Now, Brad Cooper has had his life destroyed based on the poor performance of an over-zealous cop

According to what I heard today, Young called ATT Subpoena Compliance to ask them what he needed to get from ATT in order to unlock the phone. The ATT rep told him to ask for the PUK code along with some information about the phone. Young then had to get a court order with that request and send it to ATT.

The reason for the week delay was sending the paperwork for ATT and then waiting to get a response.

I think its a huge slip-up that Cary PD wiped the phone, for sure. But, during their investigation they had dozens or hundreds of things to check on, and they just decided to check out the phone in-house and it wasn't worth doing a more involved forensic analysis on, considering it wasn't one of their top 10 leads. CPD, along with any police department ha sa limited number of hours in the day and resources available. This wasn't one of their top priorities.

^^^ i agree w that somewhat. but the woman's husband that i was conversing with is the one that came up with the pillow theory

it seems like a lot of people, male and female, are willing to convict based on nothing...or a "gut feeling"

ok, well if it was your life would you want strangers deciding your fate by going with their gut? i think not.

that's why there are 12 people on the jury...there has to be atleast one level headed person out of the 12 and thats enough to atleast get a hung jury. Odds are though that the majority of them see there is a total lack of evidence and will pursuade the jackasses to take that into account.

Websleuths is the biggest bunch of man-hating "it's for the children!" unhappy-with-their-own-lives old women I've ever seen. Well...most of them. Some people on there actually seem to have common sense, but they're few and far between.

In a case where there are lots of technicalities involving phones, cell towers, surveillance video, and computers...this was a recent post from Websleuths:

Quote :
"I don't know anything about computers, but could one of those little square things one slips into a computer be used to make the computer make a phone call? I remember something about a USB is it? port? we once took a special photo off our computer with this little thing we slipped into the side of the computer, and then took the photo to a shop to have it enlarged and printed professionally. Could something like that, some device, be slipped into the computer for usage, then removed again, with none the wiser? Just asking cause I don't know crap about comptuers. "
