he was implying something about the Nation of Islam, which changes things significantly (although I didn't really read the thread, so I don't know what he said)

No. Manslaughter, not murder 2.

and no, I don't think the sentence is necessarily light. I don't know what started the argument, but I do know that I've done much worse than shove a couple of people who had it coming. If one of them had died, I wouldn't view it as a murder.

even if the woman hadnt died

Arnold found the need to come up from Powder Springs Georgia to Raleigh NC to push down and assault a woman who she had never met who was "blind and in poor health"

forgive me for not having sympathy for her

I think 30 days in jail + the community service would have been fairer. She obviously didn't mean to kill the lady. I wish I had it on tape so I knew how vicious the push was and how the incident went down.

That said, she'll get killed in the civil suit, so I guess bankruptcy is punishment too.

Well, I wouldn't say "because she's black" I'd say "because she got in an altercation over a place in line and pushed a woman to the ground" is why I'd assume she didn't have anything.

I'd assume she was the one who broke in line because she's black though

Oh, and it probably went down like this. The blind lady walked past the black lady in line and the black lady was like "What are you blind, the line's over here bitch" and she was like "Yeah, I am blind, what's it to you nigger" and then comes the death drop.

She was charged with second-degree murder, she took a plea deal to involuntary manslaughter.

BridgetSPK, people say fucked up shit to my face all the time. Do I go around kicking people's asses for it? Do I even make physical contact (a push, chest-poke, whatever)? NO!

It's called self control. You know where people who lack self-control belong? PRISON!

Part of being a responsible human being is to control yourself. She was irresponsible and needs to pay the price for it. Instead, people tend to want to make excuses. Guess what? Racial slurs are no reason to exert physical harm onto someone. Especially an old, blind, crotchety lady. She should have laughed at her. Instead she had to be a bad-ass and push her.

This is an incredibly cliche thing to say, but black woman will still have to live with what she did, which is worse than five years of prison time. The family of the blind woman might feel she deserves prison time, but I doubt it would've done much good for either side. The old lady is still dead and the black woman, who probably isn't a violent person anyway, is incarcerated for a small amount of time. I'm sure she's not the first person to avoid jail time for involuntary manslaughter.

is there really a fine line between a killer and a murderer, if the news said a killer was on the loose or a murderer was on the loose which would frighten you more? To be honest I don't think I'd care I wouldn't want to run into any of them. A killer in some sense suggest someone who has only killed once, maybe accidental? A murderer is someone who has done it more than once, perhaps not accidental? All I know is some serial killers claimed their first kill was accidental but the power felt from taking a human life transformed them, so who is to really know what killers don't become murderers?

SOAPBOX:

This case was absurd.

I agree with TreeT just b/c I didn't mean for the gun to go off and hit you in the face while I had the gun pointed at you with my finger on the trigger, doesn't mean that I didn't kill someone.

This woman took the older lady's life.

Normally, I try not to stir the pot on racial issues:

HOWEVER,

Had a black older lady been pushed to the ground and suffered fatal injuries in the fall, infront of her daughter; and a white woman had done the pushing
THEN, a white judge slapped the woman's hand---ALL FUCKING HELL WOULD HAVE BROKEN LOOSE.

plain and simple.

^^so by your logic, pushing someone is the equivalent of point a gun at them?

so i'm an attempted murder probably hundreds of times over for when i pushed my little brother around when i was a kid?

don't get me wrong: i don't feel sorry for someone who would push someone over an argument BUT i also don't think this case was murder. manslaughter -- sure.

sure there might have been a different public reaction to this case had the races been reversed, but that doesn't make that reaction right.

technically speaking, pointing a gun at someone is less physically harmful than actually pushing them.

her point was that there was an equal amount of intent. Someone intended to point a gun at someone and it went off and killed them accidently. Somone intended to and did push someone and killed the person accidently.

people should take responsibilities for their own actions

Arnold's actions killed a woman

A blind woman in poor health who didn't physically provoke Arnold

the fact that she got off with an apology, community service and a $35,000 fine shows how fucked up the criminal justice system is

and anybody who defends Arnold is a sick individual

ok so if they were both white or both black no one would have a problem

the problem is just that blacks get a little special treatment cause everyone is so scared of being called a racist

that sucks but guess what? thats the price for building a country on the backs of slaves for 400 years
youre gonna have to give them special treatment until they forget out it

if they were both white or black i'd have a problem with someone killing somebody else without any physical provocation and getting off with community service, a fine and an apology

A few spring breaks ago... me and a few friends were in a caravan on the way to a camping spot up in Boone. We stopped in front of this old ladies house because we lost track of a friends car behind us. The old lady came out yelling and cursing all sorts of racial slurs at us. *sarcasm* Luckily for us, I was asian and the other guy in the car with me was black.

As I was trying to pull out of her drive way, she all of a sudden jumps in the way of the car. I nearly hit her. So now, we're like stuck because she's blocking the drive wayy. She's still yelling and cursing. Me and my buddy are kind of just laughing through all this. Our friends finally catch up. And a white buddy of mines gets out and calms the old lady down.

Then the sheriff shows up. We clear things up, and we all go our way.

Morale of the story: Never piss off old white ladies (intentionally or unintentionally)

Fuck NO. I'm not giving anyone "special" treatment. Not for something our great-great-great granddaddies did and that I had nothing to do with. I'm tired of that argument. Let it go.

Quote :
"technically speaking, pointing a gun at someone is less physically harmful than actually pushing them."

I never said anything about the amount of threat involved. I compared the actual physical harm caused by 2 different actions.
Action one: pointing a gun at somone- no actual harm, perhaps not even the intent of harm (just stupidity).
Action two: Pushing someone- Bruising could occur, the person will most likely at least stumble backwards, perhaps fall, possible intent of harm (at least in the lowest form), and the intent to perpetuate the situation. Once someone falls they could incur a substantial amount of physical trauma.
This thread is full of responses twisting around what other people have said.

Bottom line is both of these women are dumbasses. Movies and TV fights are not reality. If you get into a physical altercation with another person you should expect the worst. It doesn't take much for someone to be seriously hurt in a fight, or just fallling down for that matter (obviously, made clear by this situation). And you never know what any other person is capable and willing to do. Knowing this most people of reasonable intelligence avoid getting into altercations period. Not to mention no matter what happens it won't change what place they had in line, or what one person called the other. The fact that these two women let it get so far out of hand over a spot in a line is rediculous and testimony to their stupidity and immaturity.

This is not and should not be a race issue. Neither somone calling another person a derogitory name based on their race nor the fact that one side of the case suggested race was part of the fight means that the ruling itself had anything to do with race.

Could race have been an issue for the judge? possibly. But the previously mentioned things have no part in determining that.

What is racist is people assuming that the woman can't afford to pay 35K. Someone did say that they don't think she can pay because people this stupid don't make that much money, not because of her race. Even if there is a correlation between wealth and stupidity or anger management issues, that doesn't make it innately so.

I think the sentence was a little light. I know people who have gotten more community service hours for repeat traffic tickets. The money is a hard hit on the average person though. She should have at least been forced to go to anger management classes or something. I agree with others that putting her in prison for a long time may not have really done anything except cost taxpayers money. I think she should have gotten a little prison time though. And hopefully she is on probation as well, another physical altercation should land her in prison.

Although slavery was a bad thing, the best way to move forward is unequivical equallity among races. No amount of restitution/special treatment can negate the past.

Personally, that bitch should rot in jail for killing someone. Even if she didn't mean to do it, she resorted to physical violence like a 12 year old child. That bitch should be in jail, and the world would be a better place without her harrassing old ladies in dept stores.

On a side note, I was in Food Tiger the other day and i saw this younger black female approach the first person in line (there were about 4 ppl in line) and asked this young white dude to purchase her beer for her, she said was in a hurry. Well, he said fuck no... and that bitch started screaming about how racist he was. bitch

i agree that moving on is the goal but there should be special treatment to get the black people out of poverty and shame
if you did something wrong to someone wouldnt you give them some kind of special treatment without letting them do something wrong

so i guess this lady should be punished without special treatment but there should be some special treatment somewhere

The lady had to stay in jail for three days till the plea came though (most likely could not make bail).

The majority of Americans would have a problem paying that debt, even in installments. I am pretty sure that the judgment will accrue interest also.

she posted bail. If she hadn't she would have stayed in jail through the entire trial.

I don't know what her bail was set for but unless she had it laying around it may have taken a few days to get worked out. An uncle of mine was falsely accused of murder. After several months my aunt and grandmother decided they would post his bail. To do so they had to put their houses up. This took several days to get everything straightened out.
