in previous wars, we had a far more defined conflict and enemy. in this "war" the administration is picking and choosing what parts of war they want to suit them. for instance: it is ok to hold people in detention indefinitely during the conflict. but, they don't have to follow the geneva convention as they would if it were a soldier of a sovreign nation.
what president would declare that we had "won" the war on terror anyhow? when are we gonna say "ok, we're cool, there's not threat of terrorism anymore." i think that the protections that have (and will) set up to combat terrorism will be fairly permanent and thus, this can't be thought of as a war in the same sense.

As you've mentioned before, this war is not like others. Our enemy does not fight in any sort of conventional manner. They do not belong to a specific country. They do not wear uniforms. Again, this war is completely different from any war fought. We are not fighting for the traditional reason of removing an enemy that has forcibly invaded another country. Secondarily, we are also making the statement that idealogues who preach hatred, not just towards the United States, but complete and utter intolerance of all who differ from their view, are neither acceptable nor tolerable in the modern world. Bending, dodging, altering, or making new laws to suit the ends is unacceptable and completely against the idea of an open and free society, as well as against the idea of due process.

I find it predictable, of course you know that if Roberts had been able to get in on this one the outcome might have been different. Also I find it disturbing that the courts seem to have an inexaustable ability to follow technicalities to exhonerate criminals, yet now when the Geneva convention clearly doesn't apply they will follow the "spirit" of the law ? I'd rather the courts always followed the letter of the law and left the legislation upto congress. No, they do not get special treatment because they are 'crazier' than our traditional enemies. The terrorists are not traditional warriors, they don't fight in a traditional manner, and they do not fight for traditional reasons. Members of Al-Queda are crimminals who exploit the poverty, misery, and religious faithfulness of others. They are not soldiers. Why then should terrorist prisoners be treated in the traditional manner, i.e. military tribunals?
