He has to get a warrant unless there is visible evidence that gives him probable cause to search
(Like if you have a crackpipe or an open beer bottle in the cupholder)
I believe that right is all null and void if you're deemed under the influence of any controlled substance as well (Becuase you'll be placed under arrest)

Still, if a cop asks, say no... even if you have nothing. I've actually been asked and the cop let me go without much of a hassle, of course the only reason he asked is becuase he said I looked nervous at a license check (Becuase I had 3 beers and was 18). I guess if he had a good gut feeling you were a little crooked he'd give you hell about it.

Actually....you are confused. "racial profiling" would be stopping him because he is black, in an SUV, and looks suspicious. Any physical altercation, or mis-treatment after the stop would just be racist.

By the way....where are you getting your "facts" that you use to make your assertions? I am sure there are two sides to the story, and you are most likely reading the packpride version. I am not saying either side is guilty until I read an actual report of the stop (more detailed then wral had it) and here both sides of the story from each party. How do you know that Harris did not act in a threatening manner, etc. If he refused to give a license and registration during a traffic stop, I am sure that could be enough to cause the cop to ask him to get out of the car and search him. All I am saying is wait a bit before you use limited facts, and your own personal history with cops to make an assumption.

I had a cop pull me over in my expedition (while in a black neighborhood) for "slowing down in front of the wrong house"
that was a direct quote from the officer when I asked him why he pulled me over in the first place

Regardless of whatever two-bit definition you pulled off of google, profiling is behavior that covers the entire encounter, no just the pre-stop judgement. For example, the cop could walk up to the window, see that the drive is black, and automatically decide to search. That's profiling.

Now you two can decide if this just means the state of mind the police officers have during the initiaion of contact with a suspect or if it refers to the state of mind of a police officer through out an encounter.
I would argue that it is referring to the state of mind that a law enforcement official has prior to the intiation of contact and it is the basis for that initiation.
