Well punish the culprits. This still doesn't mean she deserves a payoff due to her own stupidity from McDonalds larger then the $$ most Americans will see in their lives.

The culprits were punished...

The assistant manager is serving probation.
The fiance is in jail.
The caller was charged, but acquitted.


I'm very disappointed that the caller was acquitted. I'm also disappointed that McDonald's lost their lawsuit--but that wasn't a criminal suit and the girl is free to sue whomever she likes.

I understand that a lot of jobs involve working in this type of climate.

And when something terrible happens where the climate is a contributing factor, I think the employer who created it should be responsible for its part in it.

^ I don't agree that a company which creates a particular work environment is necessarily responsible (or even partially responsible)--though I can certainly imagine situations in which the company would be responsible (Davis-Besse would be a fine example).

Part of being a responsible adult is being able to function in various environments and situations.

This is a situation in which the adults failed to be adults, not one in which a company failed to provide a proper work environment.

Hi, my name is Louise. After dropping out of high school I became a hamburger flipper at McDonalds. One day at work an anonymous person called in claiming to be a police officer told me I had to be stripped searched b.c of a possible theft from a customer. Intelligence is not one of my strong points so instead of using my brain I just went along with it. Before I realized what was going on I was naked in the managers office with a broom stuck in my twat .

Two years later I am smiling because I somehow convinced the court that it was McD's fault for my ignorance and for not knowing one of their managers was a pervert. I am thus getting 6.1 million dollars in settlement which is probably 10x my lifetime earning potential. Sometimes ignorance does pay off

Well now you're contradicting yourself. You'll admit that the management committed crimes, but now you're saying Ogborn is to blame -- well, ok, if it was just consensual, then what did the managers do wrong? The problem here -- as is the problem with many of your posts -- is that you don't exactly have a great command of the facts.

When Summers asked Ogborn to strip, it was relatively non-threatening. Summers didn't even see her naked. She just looked through her clothes while Ogborn remained covered up (with an apron). Ogborn trusted Summers, and Summers didn't really threaten her.

Where the situation got bad -- and where I totally sympathize with the girl -- is that Summers then left her alone with a large, middle-aged man while she worked out front. Ogborn didn't have a good opportunity to leave because she was _naked_, in a store backroom, and once he was in there, he basically had his way with her.

Now you can argue that Ogborn was stupid for complying with Summers to begin with -- and you have -- but here's a naive teenage girl who trusts her boss, who claims to be talking to the police. I know it's hard to imagine we aren't all grown men with college degrees from a good engineering school, but do try. She wasn't in any immediate danger when the ordeal began; but Summers turned around and put her in a very, very bad position.

You really sound like an ignorant fool. Watch the video -- the girl is cornered in a backroom with a large, imposing man. She didn't just "perform on command," she was scared shitless and she should have been.

I completely agree with you, especially after seeing the televised (20/20) report about this. I still don't think McDonald's is liable -- but clearly this was a case of direct psychological and physical sexual abuse.

In fact having seen the newscast, I think I completely sympathize with the girl. I do think she's being used by her attorneys and the media to make this into some broader social crusade. But her own situation was unfortunate and criminal in the extreme; and frankly, I'd be more inclined to blame her parents for not better educating her about "the real world" before sending her out to work at McDonald's with these psychopaths.

Well, the court didn't make McDonald's responsible for the work environment, just for not sharing information. Which to me isn't reasonable -- because on some level, it's not the normal role of a corporate franchiser to run an internal crime blotter system.

Plus I'm not sure there was anything wrong with the work climate. From what I saw, Summers was stupid but well-meaning. The guy who committed the real harm wasn't a McDonald's employee, he was her fiance (an exterminator). In fact, the other employee Summers called on refused to comply with the instructions.

At any rate ... Summers is just a total moron. Talk about the shallow end of the gene pool ...

I watched part of the newscast, and when asked why she got totally naked and started doing jumping jacks and further exposing herself and whatnot, the girl the girl says "My parents taught me that when an adult tells you to do something, that's what you do." I don't see how you can say she's not a retard.

Now don't get me wrong, the girl is certainly entitled to the justice she deserves against the manager and her boyfriend, but trying to blame McDonald's is just money grubbing. Oh and she's still an idiot.

Well, I made a comment above about "let's imagine for a second that you aren't a grown man with a college degree from a good engineering school ..." -- let me repeat that. Along with my comment about how you should never have kids -- which deserves repeating at least twice.

Here you have a girl who is just 18, and very much insulated from the world, and who has a basic respect for authority. She's lived her whole life being told what to do by her parents and teachers, and her management at McDonald's is another form of authority. Summers asked her to take her clothes off, but in a non-threatening way -- she didn't just ask her to strip, she allowed her to remain covered.

Clearly she was afraid when the man asked her to drop the apron -- but at that point she basically had no outlet; Summers had put her in a fundamentally bad situation.

I know. The girl is stupid because she doesn't know how the real world works and what her rights are vis a vis authority and so on ... clearly her limited worldview is a sign of her inherent genetic inferiority compared to us TWW demi-gods.

But while you're on that intellectual tangent, please -- do consider not having kids. When your teenage daughter starts dating the abusive skank down the street, you'll blame her when he hits/rapes/etc her because she was "stupid."

Had anyone proclaimed "this is wrong, call the cops", then she would not have gotten $6.1 million

In hind sight, these three are potentially the smartest people in the world. The manager was able to criminally strip search an employee and walk off with $1.1 million. The guy was able to strip search a chick half his age and get a blow job, only cost five years (I bet he thinks it was worth it). The "victim" gets $6.1 million for being naked for three hours and give a guy a blow job (the broom handle seems to be a different case).

I bet when the guy gets out of prison he is going to sue McDonald's also and get half a million. If the strip searching manager is a victim of McDonald's than why not the rapist?

Poor choice of words on my part, allow me to clarify. I am not defending any of the 4 people involved in this. In my opinion they are all guilty of allowing this to happen. I am defending McDonalds which i feel has no responsibility for anything that's happened here.

The girl shares in the blame for allowing this to happen to her. However, being that she is the victim here, she has already paid the price for her share of the blame. The people who have prices to pay still are the manager, her fiance and the caller.

So if your manger calls you into his office and says "Please remove all your clothes except this apron, because there's a cop on the phone who says you stole something." you're going to remove your clothes because it's non threatening? If anything, the fact that it was non threatening further proves the stupidity of the girl, it's not like the mager held a knife to her and ordered her to strip.

Except that Summers first left her with another employee, who aparently told her what the caller said and who left in disgust. At this point, warning bells should have been going off all over the place in both Ogborn and Summer's heads and Ogborn should have had the sense to put her clothes back on and demand that her manager call the real cops to verify everything.

It's also worth pointing out that this girl apparently has no clear sense of relative danger. She says she didn't try to leave because it would be embarrasing to run through the store naked, as if having to parade around buck naked infront of her manager's fiance and perform sex acts wasn't embarrasing.

Hello this is a police officer. I have reason to believe one of your employees has stolen something. Since I am not there and am only on the phone, I'll need you, a McDonald's employee, to conduct a police strip search. Also please dust for fingerprints, take appropriate crime scene photos, and do this all by police protocol even though you're not police. If anyone questions what you are doing and asks to see a badge, just tell them a police officer telephoned the store.

so then you're telling me at 18 you would have submitted to a strip search by your boss at the direction of someone on the phone? I'm not enabling anyone. The manager the fiance and the caller should all be locked up for a long time but I am saying that it concerns me that we as a society don't think that a woman who can legaly sign her life away can't and shouldn't be able to recognize and protect herself from a situation like this.

now that justice has been served I feel so much better about my life with my $6.1 million. I finally moved out of my mom's home in the trailor park and moved into the Double Wide down the street. yeah, everyone tries to say that they would have done things differently if in that situation, but how would they know? Few people here are 18 year old girls, or would know what its like to be in that situation.
However, I hope nobody here would have done what the manager's boyfriend did. Or even the manager herself. You would think she would have known something wasn't right.
Poor girl, raised to never question authority. Its hard not to blame the parents, but shouldn't parents teach their kids not to obey if what is going on is wrong? "My mama said to always do as an adult says." *sigh* Wasn't she an adult herself? She was 18, after all.

The jurors that decided to award this young woman money from the pocket of McD's are completely incompetent and should be banned from serving any kind of jury duty in the future.

Now, I agree that this girl deserves some compensation (perhaps not 6 million, but at least something) for what happened to her, but it should not be coming from McDonalds. It should be coming from the manager, or her fiance, or the guy who made the call... or the state, if the criminals responsible can't be sued for the money.

I will say, that based on the video the manager's boyfriend obviously took advantage of a very gullible girl. As far as the sexual assault conviction, the only two things that would seem to make it legally justified would be a) the manager's boyfriend telling her she is not allowed to leave (implied physical coercion), or b) the girl is considered mentally handicapped from a legal standpoint. If a), one would expect an accompanying kidnapping charge, and I have heard no mention of b) (foolish is not the same as mentally handicapped). Considering the manager's involvement, she certainly has a strong sexual harassment case. I obviously don't know all of the facts of the case, but these are my impressions from a legal standpoint. From a moral standpoint, what the manager and her boyfriend did were completely despicable, and it is amazing that the manager profited by this as well.


From a civil standpoint, this case implies an incredible level of corporate responsibility/accountability for the actions of rogue employees, and for activities that take place within a business location.
