I was going to go through small claims if possible but I wasn't that motivated to do the research to figure out what avenues to use. In my 5-10 minutes of googling, there didn't seem to be much a precedence for suing small web sites.

Moderators at other sites charging money don't systematically engage in behavior that results in the de facto theft of user registration fees in stark contradiction to the sites ToS statement?

I'd say in the past year or so there have been on 2 other forums from time to time where I've just been a straight up dick making threads over and over calling the mods hypocritical assholes and basically just flaming them whenever necessary and not once have they threatened to kick me off the site. They have mentioned banning posting and replying privileges in certain forums (think The Lounge) while still allowing it in others (think Chit Chat). I've actually apologized to most of them after they've shown to be level headed in the face of my rants and most of them actually can accept certain pieces of my point of view. That has NEVER happened on this site. Never.

One of the forums was a Risk board game forum where the moderators have shown to be completely uneven in the way they moderate user feedback. In one instance, I had another player send me a private message asking for a secret alliance. A HUGE no no on the site. After the game was over, I provided feedback saying this player did this to beware. That user responded by rating me a 0 (out of 5) on the different game play metrics. I asked a mod to moderate that and he made up some bogus reason whey he couldn't. I figured out a few days later that the mod in question was buddies with the player I asked to moderate.

It went on for about 6 pages (and not unlike this site, many users there agreed with my sentiments and assessments) until the site creator stepped in and said he checked it all out and agreed with my position and would be reprimanding the mods and if I replied one more time to the thread (he asked me once already before doing any investigation) I'd have forum privileges revoked for awhile.

If I cited any laws (and I find it extremely hilarious you remember more of the bullshit that I posted than I do) it was how it would be relevant to a standard contract or a brick and mortar type enterprise. I didn't post any advice I got from lawyers because I didn't consult any.

I have friends that make funny of me posting on TWW. Sometimes I'll think that they are right, and I need to get off the internet and quit posting on t-dub as much.

Its how bothered you get with shit like this. If I was in your situation, I would be like, "this shit is stupid, I'm done with this site." Instead, you get all worked up, send PMs, call out moderators, etc. You do the same thing with t-dub. It's just kind of pathetic.
