Basically they are not making any bars ban smoking anyway. They are just forcing establishments to take a stand either way. If a place really wants to allow smoking they can become a "members only" club like every bar that does not want to serve food does.

A lot of people do not notice this but every place in NC that sells on premise alcohol but no food is a "members only" club. The probably have a clipboard somewhere where you are supposed to sign in as a "member" or "guest" and when the cops are around they put it near the front and make people use it.

I mean you are not gonna be smoking in Waffle House anymore but you should not be smoking in there anyway, they do not sell beer and the place is smaller than a high school classroom.

Seriously? So, you think my property rights are less important than your right to come on my property and be in a smoke free environment? Riiight.

Personally I think it should be legal to lay in my car drunk and run the heat if its cold outside....especially if its an automatic in park.

That is called a DWI even if you never move.

Just another example of our freedoms being slowly taken away. Watch out all you fat fucks out there, the nanny state will be coming after all those fatty foods you love so much next.

Goddamn self-righteous assholes in government won't be content until every part of our lives are regulated. Sickening.

This isn't your fucking house or land we are talking about here. That State granted you the ability via a license to do various things in your establishment. You have to abide by the laws the State crafts. You already have to have a license to sell alcohol, but I guess you think you should be able to sell it without this, and without having to pay any tax on it, and you should be able to conduct any sort of business inside the property you want, correct?

I still find it amazing that I can go out all the time and never smell like smoke the next day.

I guess it's because i take showers and stuff like that.

also, my clothes that i go out in enter a different pile of laundry and get washed more often.

Oh and I'm a smoker that couldn't care less about this. I will just go outside or go out less. Kiss my money goodbye, bars!

People are making too big of deal about this... go outside and smoke then come back in. Some people want to visit various places without breathing a ton of smoke and smelling like shit if they go somewhere after that place.

This is horrible...we are becoming more and more like China each day. I despise smoking and smoke, but if someone wants to allow smoking in their establishment they should have the right to.

Just like I, as a non smoker, have the right to avoid that establishment because of it.

^ i'll give you points for that. we are not becoming china. i know i said it earlier, but like i summed it up last night --- even if the government takes away this liberty and 20 more over the next 5 years, we're still not even close to china and i'd never move out of the usa (except to germany, but thats not politically motivated)

im starting to get my sense of smell and taste back, its really really weird. but i'll tell ya the best thing about quitting... not having to always be stopping for cigarettes and running out at weird times and jonesing etc etc.

honestly, now that i can smell it... i really dont think it smells that bad. the actual smoke is irritating, but i kinda like the smell

know what pisses me off more than smoke indoors? people who smoke while walking down the sidewalk. or outside front doors. when i smoked, i always felt guilty unless i was like 20 feet away from the entrance of the place i was smoking outside of. and i always backed up a good 5-10 feet away from any other person when smoking at... for example... a bus stop.

to me its 20 times more of an issue of inconsiderate people than a second-hand smoke thing. but i still think they have the right to do it... just like people should have the right to call them a dick for smoking in a sidewalk mob

This sentence kind of makes my point. I have issues with the concept that our ability to live our lives as free men and women (in a relative, not an absolute sense) must be due to the courtesy and benevolence of a complacent state bureaucrat sitting in a dank office in the bowels of a government building in Raleigh.

Incorrect, as has been pointed out many times in the other thread and this one.

Quote :
""Private club". – A country club or an organization that maintains selective members, is operated by the membership, does not provide food or lodging for pay to anyone who is not a member or a member's guest, and is either incorporated as a nonprofit corporation in accordance with Chapter 55A of the General Statutes or is exempt from federal income tax under the Internal Revenue Code as defined in G.S. 105-130.2(1). For the purposes of this Article, private club includes country club."
""

It seems to me that to be a private club, all of these must apply:

- maintains selective members
- is operated by the membership
- does not provide food or lodging for pay to anyone who is not a member or a member's guest
- is either incorporated as a nonprofit corporation in accordance with Chapter 55A of the General Statutes or is exempt from federal income tax under the Internal Revenue Code as defined

This is an "and" condition, not an "or" condition. So unless your bar can somehow become nonprofit, it's not exempt. This was used to make sure lion's club, vfw, etc could still allow smoking. If you're a business, no smoking allowed.

I would say he's not only saying fuck the law, which is fine, but also fuck his non-smoking customers. Not that big a deal, though. And he can probably get away with that, for a while. The punishment is non-criminal and will only be issued to bar owners ($200, big deal) if the health inspector chooses to issue it.

Still, he'll eventually realize that's pointless when he notices that none of the other bars who have followed the law don't lose any business.

If you agree with this law, I suggest that once it goes into effect and the bars actually start banning smoking, you patronize those bars more frequently for a while to make sure business doesn't dip much at the beginning. Either way, everything will even out as it has every other place where smoking has been banned.

i am of the opinion that if a place of business doesn't allow anyone under the age of 18 on the premises, then they should be able to allow smoking.

any 18 year old can purchase cigarettes and make the decision whether or not to be around it.

OR

make it a cutoff time i.e. no smoking between 4 am and 8 pm or something

what about bowling alleys? most of them have rules that minors are to be chaperoned after a certain time. does this apply to them as well?

I don't know if bowling alleys are affected, but whether they are or not, it has nothing to do with whether they allow minors. All of that stuff about minors was stricken from the bill before the final vote. It's simply a ban on all bars and restaurants now, and government property I think.

Restaurants complained that bars would gain an unfair advantage if they allowed smoking and restaurants couldn't, so they widened the scope to cover bars too.

But the fact that you can vote them the fuck out trumps all. With the massive sums of lobbying money that was poured in by big tobacco to stop this (I'm assuming here), and it still passed, tells me just how much will of the people has spoken. And like I said, if someone has a massive problem with it or their business is deteriorated so much, they can move 180 miles north or a couple hundred south, problem solved. Again, at some point common sense and human decency (I can't stress enough how shitty it is that smokers don't really give a fuck that they pollute the air for the non smokers) rather than some sort of absolute mentality about the sanctity of claimed rights has to lead us down a new path.

Yay! Maybe now they will ban cars because lord knows how much exhaust pollutes mine and your lungs!

Hmmm... maybe not, but wouldn't that be grand? I smoke sometimes when I am all drinksy but I don't mind the ban, I usually prefer to smoke outside anyways when weather permits. Maybe this will cut out my drunk-smoking. That too would be grand.

bowling alleys up here in NY are smoke free by law

Now it's just annoying when my bowling team is bowling a 3 game set against a team with smokers on it. After each game (and sometimes in between frames) they want to go outside to smoke...holds the game up

The ban goes into effect on January 2, 2010.

It's sad that the gov't has to intervene and force all the inconsiderate assholes to go outside to smoke. In our society, it should be common courtesy to go outside and smoke and spare the 80% of the population that doesn't smoke. That's right, you might have to put down your greasy ass chicken wing at Sammys for a couple of minutes and go outside to indulge in your disgusting habit. Boo fucking hoo.

If you're at a restaurant or a bar and you have to fart, you go outside. Same applies for smoking.
