This is utterly absurd. How could you possibly think a bystander is an accessory to the crime by not acting. There's no duty to act to save someone else (unless a special relationship exists, but that's not this case). There's no duty to put yourself in danger for someone else. If some crazy dude is swinging a metal rod around, I'm not jumping in to save 2 strangers, or I'd be sitting there with a cracked skull and broken bones too, and what good does that do?10/18/2011 1:22:21 PM |

You absolutely can't be found guilty for failure to act (like I stated above). The only conceivable way a person can be compelled to act is if there was some kind of relationship (a father has to protect his child if possible, a lifeguard has to attempt to protect a drowning swimmer, and someone who causes the injury cannot leave the victim without helping). Alternatively, you can be compelled to act if you were a member of the conspiracy, and did nothing to stop it.
However, none of those situations apply here. THERE IS NO DUTY TO ACT IN NORTH CAROLINA, whether it's under tort law, or criminal law. And the Good Samaritan law you quoted, also doesn't apply in all situations here. If you start to help someone, and you screw it up, you could be liable. If you start to help someone, and then negligently stop, you could be liable.

^That was my point. The good samaritan laws have nothing to do with stopping a crime in action, but with negligence, and so isn't even relevant to this thread. Two different realms of law. I've saved several people's lives not because I am 'super awesome' but because I hold myself responsible for others' well being if it is in fact within my ability. People that disagree with my sentiments are why the planes were taken over by terrorists with simple box cutters on 911...I'm not here to judge, we all make our own choices in life. Good men failing to act is a terrible thing. No, there's no law saying you must act proactively to save someone, but that employee in particular was out of control and once the two women were down he kept at it with a gleam in his eye and should be charged with a crime - he went beyond self defense and methodically continued inflicting damage against people he had just rendered helpless...simple assault doesn't justify those two women...someone's sister, mother, daughter, girlfriend, etc. getting bludgeoned to the point it went to. 10/18/2011 6:27:15 PM |

Because it is certainly a tragedy for family members to hear their kin was not properly raised to the standards of society, and thus faced the consequences for their outlandish behavior later on down the line.

we have an ex con who served his time and debt to society, and then got out and got a regular job. He was just punchin' the clock trying to support himself, pay taxes, and maybe make a little fun money for Halloween and Christmas.
