^uh no, everyone should be held to the same standard because everything is situational and different. Besides working in the justice system doesn't automatically make you a more moral person, you have the same motives and objectives as everyone else in the world and you have the same options of how to get where you want.

^^I know this may be splitting hairs, but Nifong did not get 1 day in jail for that. He got a day in jail for contempt of court, because he was ordered by the court to disclose all of the information from the DNA tests he had conducted, and he failed to do so. The short version of the story is that he had a private firm do the DNA testing work, and when some of the results weren't helpful to the prosecution, he directed them to make a report leaving that information out.
The reason I mention all of that is because his day in jail was only based on the failure to do as the court asked and provide all the DNA testing info.
He was disbarred and removed for making inappropriate extrajudicial statements that had a likelihood of materially prejudicing the public, lying to the court, violated open discovery laws and constitutional protections, etc. The system really didn't give two shits that he prosecuted innocent people. The rules for prosecutors only require they have probably cause to charge. Beyond that, Nifong was free and clear.

^^^ fair enough, but the judge even pussed out on that. He could have given him up to 30 days for contempt of court. In the context of everything else that would have seemed fair.
What I take from this is that private defense attorneys are expected to conduct themselves in a more honest and ethical manner than elected prosecutors that use cases to win re-election. 12/4/2012 10:54:47 PM |

I saw him recently and felt really badly for the guy. He looked both somber and frail, which is a far contrast from the beacon of confidence he once was.
He's dropped a lot of weight, which I can only assume is from the stress, and walks with a slow, lost gait.
I know a lot of people he's helped (many of whom are/were on this site), so it's really sad to see it come to this. 7/30/2015 10:25:40 AM |
