If he pursues it, then the kid's parent will get a lawyer. That lawyer will then threaten with assault charges. There is no way in hell it's going to go to court at that point, and the best case scenario would be to still be able to walk away, which he can already do.

This could just as easily be the parents in shock and not really knowing what to do in the situation right then and there. Yes, they might have done nothing. Or they might have locked the kid in a cage and beat him with chains. We have no way of knowing. But what we do know is that if charges weren't pressed then this goes to civil court, and good luck proving any of this in civil court without the photographs. Plus you get to have your name all over the news and thus all over the internet once it gets to court because you know the local media would love to report on something like this.

The only people that can decide whether or not to press criminal charges is a DA though, right? They can file a complaint or whatever with the police but for all we know that has already been done. They could sue OP I guess but they would probably do that anyway if it applied.

I somewhat understand this attitude as I feel like my first reaction would be to break the phone and be done with it, but that is illegal and you'd be destroying the best chance at concrete evidence proving your side of the story. There are also many outcomes to a lawsuit that do not involve money, but it's not like it's fair to have to miss work and spend money on a lawyer to remedy a situation caused by another.

As far as the detention of the kid, I don't see anything wrong with it. NOT A LAWYER THOUGH.
