I have had two co-workers get DWI's in the past month. Neither were involved in an accident, one was speeding and not sure about the other.

^ Photographing fatality wreck scenes is normal "standard operating procedure." In Wake county CCBI responds to do the photographs for evidence for fatality wrecks and most wrecks with major injury.
For this department in Illinois they may take their own photographs (that I do not know).
As far as removing her clothes, that is nothing I've ever heard of.
My few theories for that are:
A. The young lady was messing around in the car with her man as they were both intoxicated and doing whatever, causing the wreck.
B. The clothes could have been removed or partially removed by medical personnel on scene during a life saving attempt.
C. The wreck itself could have torn/ripped/removed clothing depending on the wreck/ejection etc.

But TKE-Teg, this actually isn't anything new at all. I'm not sure if the supreme court just revisited the issue to make a more clear judgement or what, but this is how it's been for as long as I've been a cop.
If you stop a car for traffic/CR/etc etc, you have always only had the reasonable amount of time during the normal course of a traffic stop to: A- Develop MORE reasonable articulatable suspicion that another crime is occurring (drugs). Which this has to be substantial suspicion, or even actual probable cause, but never a "hunch" due to history etc. B- Probable cause, usually due to the plain view doctrine or confession from occupant C- Consent after the stop has been completed and the driver has been told they are free to leave D- Vehicle sniff as you're completing your warning/citation, vehicle/insurance/registration/warrant check etc.
This case law is not new by any means as long as I've been in law enforcement, and it looks like it's clarifying if anything. 4/22/2015 2:02:21 PM |
