So this morning I heard that the "BCS expert" has basically recanted his previous statements and said that the gap between Ohio State and Auburn is too large and that its pretty much impossible for Auburn to jump Ohio State in the computers.

Maybe, but if there are inconsistencies or recollections are unclear, presence of alcohol, etc. AND there are 2 different DNA samples it makes it pretty unlikely you're going to get a conviction so you don't bring it to trial.
