Everyone has to share the road and swallow their pride, and do whatever is necessary to not contribute to more dangerous conditions, even if you are right and they are wrong -- others share the road. Innocent passengers -- children even -- are all in it together. There is no room for vigilantism or personal vendettas against other drivers.

You know, I actually don't brake check all that often.
If someone is riding my ass, I give them a chance to get off it, and most of the time, they do so before I decide it's brake-check time. And, I think my tolerance for tailgaters is a lot more lenient than other people's. You've got to be pretty fucking close before I'll brake check you.

Most of these don't directly apply to NC, but I think I would conclude that making a +5MPH effort to pass slow-moving traffic would always be a legitimate use of the left lane. If someone wants to go 105MPH, you should not have to speed up to do so if you're steadily gaining on traffic to the right (+5MPH is 440 ft/min). We should note that some cars aren't stable to drive above certain speeds (tire ratings, inherent design), and drivers themselves only have skills that permit them to comfortably travel at certain differentials above the limit (I've been 25 MPH on US 264 before due to heavy snow in Wilson Co.)
