the issue is this kdchadawlaal alasorry,,,anyway.NCSU had designated this and the state of NC by default, as a "designated public forum" for free speech. These areas have the the same level of protection as a "quintessentially public forum" as far as free speech is concerned.The state may reserve the forum for its intended purpose, communicative or otherwise, as long as the regulation on speech is reasonable and not an effort to suppress expression merely because public officials oppose the speaker’s view. So long as the forum is open by the State, they must obey the same standards as the QPF. Any laws affecting the ability to communicate in these areas are subject to "Strict Scrutiny" analysis. The only laws restricting free speech to ever survive strict scrutiny are the laws which provide that no campaigning may occur within ~50 feet of a voting booth, which you may have noticed when you went to vote this time.That being said, NCSU is a public school. Here, in order for the State(NCSU) in the person of school officials to justify prohibition of a particular expression of opinion, it must be able to show that its action was caused by something more than a mere desire to avoid discomfort and unpleasantness that always accompanies an unpopular viewpoint. I think that it should be an easy burden for NCSU to meet in this case. Not only may a school discriminate against speech that would “substantially interfere with its work…or impinge upon the rights of other students,” but also from speech that is, for example, ungrammatical, poorly written, inadequately researched, biased or prejudiced, vulgar or profane, or unsuitable for immature audiences. In conclusion, NCSU has created something of a mess for itself by designating this a "free expression tunnel," although I think that any argument to allow this type of speech on a public campus could be easily overcome. I look back at all of the stupid things I did growing up and do not recall ever wanting to paint racial slurs on government property. I am not saying these kids deserved to be punished severely, but I would like to hear the reasoning that made them think this was a good idea.
