http://www.usatoday.com/story/sports/college/2015/01/22/lawsuit-filed-against-north-carolina-ncaa-on-academic-scandal/22173755/
Quote : | "The suit, which seeks to become a class action, was filed in a North Carolina state court on behalf of women's basketball player Rashanda McCants and football player Devon Ramsay by lawyers from the same firm that is pursuing the Ed O'Bannon antitrust case against the NCAA concerning the use of college athletes' names, images and likenesses.
Rashanda McCants is the younger sister of former North Carolina men's basketball player Rashad McCants.
This case involves allegations of breach of contract against UNC for a failure to provide "academically sound classes with legitimate educational instruction."
The complaint also accuses the NCAA of negligence because: "Although the NCAA's rules prohibit academic fraud, the NCAA knew of dozens of instances of academic fraud in its member schools' athletic programs over the last century, and it nevertheless refused to implement adequate monitoring systems to detect and prevent these occurrences at its member institutions." I don't like Carolina and this scandal as much as the next guy, but BULLSHIT! You can only make this argument if you say the two plaintiffs have zero individual responsibility for the result of their education.

If you came to State, was lackadaisical in your schoolwork and took jerkoff classes that didn't prepare you for your own life after college, is that the school's fault or yours?
This is like the people crying when they lost their home in the housing collapse. Yeah, it was a scam, but you were part of the scam too! Unless these individuals can show they made an honest effort at their education, they were part of the scam at Carolina.

^Yes and no. If you, as an athlete, are told to take sham classes and basically have your schedules picked for you, then it's a different story. The reason most people give for not wanting to pay collegiate athletes is they get a "free ride to a great university education." If you aren't getting that education, then why does the school get to make money off of you?
I'm certainly not saying that the athletes are not at all culpable, but very few 18 year olds are going to tell their couch or counselor "Nah man, I really want to take Calc 2 this year, not AFAM, I'll put in the extra time and study, I know I will." 1/23/2015 2:18:32 PM |

If you, as an athlete, have an interest in your education, you're not going to take sham classes and basically have your schedules picked for you. They didn't instigate the program but they were complicit with it.

The suit would certainly make more sense to come from athletes or students who legitimately took AFAM classes or actually did work, and now their degrees are coming in under scrutiny. 1/23/2015 2:42:51 PM |

Quote : | "The suit would certainly make more sense to come from athletes or students who legitimately took AFAM classes or actually did work, and now their degrees are coming in under scrutiny." |
Exactly. Although the lawsuit only limits to those on athletic scholarships, regardless of their major and how seriously they took school. So if you're a student that wasn't on a sports scholarship and took a no-show class, you have no recourse.
Quote : | "The suit seeks to create two broad classes of plaintiffs:
— A damages class comprising anyone who attended UNC-Chapel Hill on an athletic scholarship and enrolled in a broad range of African and Afro-American Studies and/or Swahili classes between 1989 and 2011. The list of those classes runs for 12 pages of the 100-page complaint.
— An injunctive relief class comprising anyone who attended UNC-Chapel Hill on an athletic scholarship or is currently attending the school on an athletic scholarship." |
I know a guy that was a walk-on on the UNC football team under Bunting. I guess he has no recourse either, although he's fine, he works at Google.
Quote : | "The suit seeks unspecified damages and asks for "the formation of an independent commission to review, audit, assess, and report on academic integrity in NCAA-member athletic programs and certify member-school curricula as providing comparable educations and educational opportunities to athletes and non-athletes alike."" |
Hey, I'm all for that. Let's do my plan that can do this:
1. Stop making sports an important part of whether a person gets enrolled or not. If you couldn't cut it in high school, you won't cut it in college. 2. Drop the notion of athletics scholarships, that way the notion of athlete and non-athlete completely disappears from a university perspective. 3. Remove all athlete-centered programs regarding to education. There's non-athlete-based tutors available. 4. Make all sports at universities club sports (where the clubs pay their own bills) instead of varsity sports.
(In other words, to remove the differences between athlete education and non-athlete education, treat them no different than non-athletes.)
and 5. If you're going to pay players, go ahead, but aforementioned club team loses their tax exemption. (that applies to alumni donations too, fuck the Phil Knights of the world that use their alma mater for tax evasion)

I agree with this to some amount. However, in some cases we are talking about people who can't read at a high school level who have been made all these promises and told to basically "trust us to handle things for you" (at least that is my understanding).
What choices did they have? 1. Go to this big name institution and try for a pro career and if they don't make it, go get get a minimum wage job or 2. just skip that and go get a minimum wage job.
FYI, the fun starts on page 44. Page 74-75 has the bulk of the argument about why this isn't the athlete's fault. There are some pretty big holes but for every one thing an athlete has to explain, UNC has 50 things to explain. Which is why I say this never sees the inside of courtroom, one way or another.
Quote : | "211. During the Class Period, UNC was in a far superior position to its student athletes to assess whether the AFAM paper courses in which Plaintiffs and the Class were enrolled were academically sound. During the Class Period and until very recently, Plaintiffs and the Class did not have access to the non-public, internal UNC information they would have needed to make this determination. For example, The Raleigh News and Observer had to sue UNC in January 2014 to obtain non-public information and data about the AFAM paper courses, the student-athletes enrolled in them, and related information such as course titles, GPAs, and majors. Until very recently, Plaintiffs and the Class lacked the information needed to determine, e.g.,:
a. whether AFAM paper classes were taught or supervised by a UNC faculty member or otherwise involved a faculty member;
b. whether Plaintiffs’ and class members’ communications with Crowder and other non-faculty members regarding AFAM paper classes were shared with the faculty instructor of record;
c. whether coursework submitted in AFAM paper courses was reviewed and graded by a qualified faculty member;
d. whether coursework submitted in AFAM paper courses was reviewed in itsentirety;
e. whether attendance at courses designated as lecture courses could be excused by administrative staff or faculty; and
f. the roles of UNC athletic department personnel and academic advisors in creating, maintaining, supporting, and encouraging AFAM paper courses" |

Under the logic of this suit, should they sue the state for providing them an improper high school education then?

3. go to the D-League (for men's basketball players)1/23/2015 2:55:28 PM |

Yes, I hadn't thought of the D league. It is still there though if they don't get drafted (or spend all there time practicing basketball instead of earning a worthwhile degree).
Suing the school system for providing in improper education is not the same as suing a University. Student-athletes are not providing any service to the school where their compensation is that they receive a quality education. (I suppose if it were possible to sue the state then the tax payers who are funding it would be the party to do it?) 1/23/2015 3:09:51 PM |

He has an argument then if he made an honest effort to get an education and didn't sign up for no-show classes and fake independent studies.
My problem is more with people that were setup to cheat, knew they were cheating (how low does your IQ have to be to not think it's odd you get 3 credit hours for a class that never meets? lower than the IQ required to learn basketball or football plays), and went along with it because it suited their interests, and now they're suing.

This looks promising for some lolz.
Quote : | "Going through with the litigation would be costly. Discovery was about to begin, putting the University of North Carolina on the hook for a cool half million, estimated costs, just for the discovery phase alone. North Carolina’s legal team further estimated the costs of litigation, trial, and appeal of upwards of two million. At the end of the day, UNC felt it had a good chance at a favorable ruling, but there was also a legitimate chance that it would go the other direction; that UNC would be on the hook for full damages and the most dreaded result - that UNC would have to reinstate Willingham to her job" |
If the most dreaded thing on a UNC Fans mind is to have to reinstate Willingham, they are in for some dark days to come.
