If you're referring to what I said terp, I was trying to say that if he in fact planned the whole thing, that fact should have no bearing on the way the case is reviewed. I have to assume that if the cops knew he had planned the whole thing it wouldn't have ended up as serious as it is. As it is, they did not know (assuming he actually planned it) so they cannot use the excuse that he was playing it up for the camera. I don't care who is a "douchebag" and who is a "powertripping egomaniac," it does not matter. All that matters is how the situation escalated and was handled.

ok terpball we get it...the ONLY thing that matters was that the cops touched him and tased him, regardless of what he did the previous 3 hours in the auditorium

anything else doesnt have to do with anything

- talking shit to the organizers was clearly an acceptable thing to do at something organized by the...organizers
- skipping ahead of all the other students who had questions, and who peacefull waited in line 2 hours, and who acted civilized unlike this faggot...thats also not important at all
- when the police went to get him to leave (NOT TO ARREST HIM) for being a complete dick, and he shoved the cops, that is also completely irrelevant

you're basically saying that student had the right to jump ahead of everyone in line...he had the right to talk longer than everyone else...he had the right to stay when they told him to leave...he had the right to shove the cops when they tried to make him leave...but the cops didnt have the right to initially even try to get him to leave?

Yes, they absolutely could have handled it without a taser. It's also much safer for all involved if they do use the taser. Physical force has a much greater chance of long term serious injury than a 3 second shock.

Family attorney Rick Alexander said Delafield's death could have been prevented and that there are four things that jump out at him about the case.

"One, she's in a wheelchair. Two, she's schizophrenic. Three, they're using a Taser on a person that's in a wheelchair, and then four is that they tasered her 10 times for a period of like two minutes," Alexander said.

According to a police report, one of the officers used her Taser gun nine times for a total of 160 seconds and the other officer discharged his Taser gun once for a total of no more than five seconds.

A medical examiner found Delafield died from hypertensive heart disease and cited the Taser gun shock as a contributing factor, the report said. On her death certificate, the medical examiner ruled Delafield's death a homicide.

The family said it plans to sue the Green Coves Springs Police Department now that it has all the reports regarding their loved one's death.

"We're going to try to compensate the estate and the family and try to get justice," Alexander said.

He said he believes the evidence weighs heavily in favor of Delafield's family and that justice will be served.

"I think that this evidence is going to show, along with some of the evidence we've collected outside of here, that there is no reason Emily Delafield should have died that day," Alexander said.

He said he plans to file a notice to sue sometime before the end of the year.

i went into this issue automatically in favor of the student.

you see, I'm highly prejudiced for free speech in almost any case, and against abuse of power by the police. i've been following a number of local and national police-abuse incidents recently, and some of them are disgusting in how much the cops think they are above the law.

so after reading the articles -- but before viewing the videos -- i was already convinced that the student had been a victim of excessive police force.

then i watched the video. actually, four different videos, from different angles and sequences.

and now my conclusion is that the student was excessively belligerent, combative, and refusing to obey lawful orders to cease and desist. the student was actively trying to hijack a public appearance by a US Senator to further his own agenda, at the expense of the Senator and the public who had assembled to hear the Senator speak. this was not a forum for this particular student to air his own laundry list of grievances and pet conspiracy theories.

he had his chance -- more than his fair chance -- to speak and ask questions. Instead he felt that HE was above the law, and the rules of common public civility. the local police had jurisdiction and authority to protect the rights of EVERYONE there, including the Senator and the rest of the attendees. their job is to remove people who attempt to disrupt the assembly.

The fact is, if he wouldnt have been a long-winded, blowhard fuckwit, and just asked his goddamed questions like a normal person -- you know, succinctly and to the point --- instead of waving his Book-of-the-Month around and bloviating like he thought he was the Master of Ceremonies.... he could have said what he needed to say, and allowed Kerry to attempt an answer, and not had any problems.

Instead he got physically confrontational with Law Enforcement who were just trying to do their job.

He got what he wanted. And he got what was coming to him.

Fuck that guy.

^ i dont have video access at work. so all i could do was read articles and commentary.

having read a number of articles about this event, and having recently followed a number of legitimate police abuse cases, li was biased in favor of the student. the articles and commentary gave the impression that the student was merely asking questions, and was being denied an opportunity.

THEN i finally saw the videos. four of them. and it became clear that the student was belligerent, hostile, combative, and unresponsive to reasonable orders by event security.

now do you have anything meaningful to add other than "you're stupid"? or is that the best you can do when confronted on your inadequately reasoned position?

John Kerry was highly uncomfortable and embarrassed, and stood up there mostly silent, except for mumbling a few mushmouthed, weak, vaguely unspecific, and largely unconvincing protests.

if he was AT ALL interested in giving that kid a forum to speak, he would have TAKEN CHARGE of the situation and told those cops to stand the fuck down.

hes a ranking US Senator and decorated Vietnam combat veteran. I think he can handle a half dozen campus security cops.

all he was doing up there was covering his own ass. muttering a couple pathetic attempts at protest, so he can say later that he supports students and free speech. Kerry wanted that guy out of there as much as the rest of the audience did. yeah, no one wants to see someone get tasered for trying to speak their mind, but goddamn, that kid just wouldnt stop.

that student continually struggled and physically resisted all attempts at restraining him. he was the one escalating the situation. and he was a big guy, bigger than some of those cops, highly agitated -- it was getting close to the area where the cops could possibly lose control. what if the guy went for one of their weapons? then what?
