"We are working very diligently to try and find out how this could have happened," Freeman said. "The file was in one courtroom, and it would have been a relatively simple matter to find out where the file was and have it brought up to the courtroom. That is something that should have been done."

Correction officials said that, had the hearing occurred, Atwater could have been sent back to jail then or another court date, which would have been similar to a first court appearance, could have been scheduled.

The state Department of Correction has also opened an investigation into why it took several months to bring Atwater to court for that probation violation. He pleaded guilty to a gun charge in June 2007, violating his three years’ probation from a 2005 break-in, correction officials said.

Atwater was arrested Feb. 20 on the probation violation, released under a $10,000 secured bond and set to appear in court March 3.

Atwater should have been arrested in June, the corrections department said, but his probation officer did not fill out the necessary paperwork until five months later.

The clerk of court also took the blame for another clerical error, relating to Atwater's 2005 sentence.

A judge sentenced Atwater to nine months of intensive probation that required him to check almost daily with a probation officer. A clerk, however, did not put the correct information in Atwater's file, so he was placed on regular probation.

"That the opportunity was there, that in some way that some intervention may have occurred, obviously, is something that is going to be of grave concern to us forever," Freeman said.

Both Atwater and Lawrence Alvin Lovette, 17, also charged with first-degree murder in Carson's death, have criminal records.

Atwater's dates to 2004 and includes charges of robbery, drug possession and resisting arrest. In 2006, he was sentenced to 24 months' probation for possession of a firearm as a felon.

Lovette's criminal record includes charges of breaking and entering and larceny, for which he was on probation when he was arrested Thursday. He was due in a Durham courtroom this month on charges of first-degree burglary, felony larceny of a motor vehicle and felony larceny after breaking and entering, all related to two crimes from February.

He was also charged Thursday with first-degree murder in the Jan. 18 shooting death of Duke University graduate student Abhijit Mahato and with several other charges connected to crimes from mid-February.

Atwater and Lovette both went to Jordan High School in Durham and withdrew in 2002 and 2007, respectively, Durham Public Schools spokesman Michael Yarbrough said Thursday.

Atwater later enrolled at Apex High School, where he once got in a fight with another student over a blue bandanna he displayed on campus, Apex police Sgt. Jacques Gilbert, a school resource officer, said.

"We interviewed Mr. Atwater. He indicated the blue bandanna represented a gang that he was affiliated with," Gilbert said.

The gang was based in Durham, where both he and Lovette were arrested this week.

But Durham police Chief Jose Lopez said Thursday that at this point in each of the cases, he does not want to "give any credit to any gangs."

"I believe they are two young men who were involved in some robberies and homicides, and they have been charged as such."

Atwater, who was arrested Wednesday, was being held in the Orange County Jail without bond. Lovette was being held in the Durham County Jail without bond.

Lovette could make an appearance before a judge as early as Friday to face charges in Carson's death, Orange County District Attorney Jim Woodall said."

Investigators learned numbers on the phone traced back to a number associated with Demario James Atwater, Cline said.

Atwater, 21, is not charged in Mahato's death, but Durham Chief Jose Lopez said Thursday police were looking to see if he might have been involved.

District Court Judge Craig B. Brown ordered Lovette to be held on a $3 million bond, appointed him a public defender and set his next court date for March 27.

Afterward, Brown, a graduate of both the University of North Carolina at Chapel Hill and Duke, spoke for about 5 minutes, saying he was going to call on the governor for a special session on anti-gang legislation.

"I respectfully and sincerely ask the governor to call a special session of the Legislature. I'm sending an SOS in Raleigh," he said.

The 17-year-old former Jordan High School student was wanted on a first-degree murder charge in connection with Carson's March 5 shooting death in Chapel Hill. Durham police arrested him early Thursday after nearly two hours of negotiations.

Lovette is expected to appear before an Orange County judge Friday afternoon to face charges in Carson's death. The 22-year-old UNC senior was found shot to death about a half-mile from UNC's campus.

Durham police have said, at this point, they do not believe neither Mahato nor Carson's death was gang-related. And Chapel Hill police have said they are investigating all possibilities.

sad thing is that the current setup in the Clerk's Office is actually a massive improvement over just a couple years ago I worked there during the years I had dropped out of NC State, the place was a complete clusterfuck. The criminal justice system in the Triangle is an ongoing disaster...

I am sure it was not a cell phone with GPS. They could occasionally get a tower signal, but it would be hard to find the actual physical location of the phone.

I wonder if he replaced the SIM card after a while. Seems strange that the phone bill would be paid for two months after the guy passed away.

it's very easy to get a reasonably accurate position of the phone. for instance, the iphone does not have GPS but can still "estimate location" just by using cell towers--and it's usually pretty much right.

doesnt matter if he changed the sim, the IMEI would be the same

I don't think my phone is capable of that and it sounds like the guy had a phone similar to mine (ipod + phone < $300)

How accurate would an old phone be? A radius of a few miles would do little help for police, whereas a few hundred yards might would make a difference.

They had another guy involved in custody at the time and I imagine they figured he sold the goods.

pretty sure all phones have to have basic gps or triangulation capabilities by law for the E911 feature on all us cell phones (where when you call 911 they can tell your general location using your cell phone immediately)

Yep, it doesn't matter what phone it is, they can detect what towers it's closest to and figure out a relatively close position.

I can go in to this thing on my phone and it tells me that I am on Hunters Club Dr. It even works inside my house where my Garmin GPS does not work.

You would be right. Any phone made in the last 5-6 years can be gps tracked. But only from an active call, they can't hunt down a phone that is just turned on (at least, not legally, yet).

^ i dont think they actually have the full blown GPS chips that communicate with a satellite...but they can triangulate your position based on local towers' signal strength (and its pretty accurate now with the high density of cell towers...see the iPhone)

i can verify that while vast improvements have been made in both GPS and triangulation, in order to have hard evidence, they need to have evidence of both to prove a location

this is not from a legal standpoint, this is from a technical standpoint. couple of coworkers are called in as expert witnesses from time to time.
