i understand this type of regulation. i'm saying how does it apply to paint on a house? is there a maximum amount of blue? pink? green? is there some law that says any lettering on a house is considered signage? if so what was the intent/purpose of that law when it was written and did it envision prohibiting actions like this? would he be considered for a variance or special exclusion?

The original was some words painted directly on the house, the last image I saw ITT looked like a sign attached to the house:
But Cary's complaint was probably made when it was nothing more than paint applied directly to the house.

The town of Cary tried to fine him for violating town ordinances that specify how and where signs can be displayed, but the American Civil Liberties Union sued on his behalf, saying the message was political speech.
U.S. District Judge Louise Flanagan ruled in December that the town violated Bowden's freedom of speech and ordered it to pay $46,197.27 in attorney's fees and court costs. The town had appealed the ruling.
Bowden revised the message in February, inviting passers-by to tour "some of Cary's finest engineering and construction." It continues, "Oh by the way, now I have lung cancer but remember I put up a good fight."
Bowden is survived by his daughter, her husband, his granddaughter, and his brother and sister-in-law.
A service to celebrate his life will be held at Fellowship Baptist Church Ministry Center, 1701 Bud Lipscomb Road in Willow Spring, from 11 a.m. to 2 p.m. Saturday." |

What does this mean in terms of his lawsuit against Cary? Do they still have to pay his lawyers and give his family $1 if they lose the appeal? Or is it all through the ACLU and it doesn't matter that he's dead now?

His daughter has no desire to continue his fight in any way. She just wants to sell the house for what she can get for it, and move on. I even offered to take over for her but she just doesn't care. well whats sad is that the sign lawsuit was a win-win situation for Cary since it was never established that they should owe him for any negligent engineering/construction of the widening project aka the root of all the problems. he lost sight of the prize (his property value). now its being sold as is without warranty (since they would have to cover the known defects under a warranty otherwise or at least disclose it to a risk-taking buyer that doesn't exist).7/17/2011 4:07:56 PM |

It's weird how you put distraught in quotes, when it doesn't mention anything at all about her state of mind in the article. Then again, her father just died, do you think that's an inappropriate response?

People inherit shitty houses all the time. I have toured a large number of the estate sale homes currently in the market in the Raleigh area. I have learned that there are two types of people selling estate properties.
Type 1: Want to dump the house while putting zero effort into rehabbing the home. Homes are usually in disrepair and/or look like the Brady Bunch barfed all over the interior. Few people are willing to buy houses in those conditions so they sit on the market for some time.
Type 2: Gut the interior or significantly rehab the home. Houses tend to sell for more than they would have if in type 1 condition and definitely sell faster.
So yeah, it sucks she inherited a shitty house, but she's not in an abnormal situation. I bet everyone else who's ever inherited a home that looks like crap wish they could get their neighbors to help pay for some of the repairs.
