What I found funny is that they said the guy driving the truck that hit them just got out and walked "home" or wherever he had to go. Just left the truck there...
now that's drunk.

In the original post, I had siad there were two things that amazed me about this situation;...
1) He had enough speed, even in a big truck, in a parking lot of this size to be able to do this kind of damage.
and ...
2) He was able to make it TO this parking lot being as drunk as he was.

Unless a witness saw exactly who got out of the driver's seat after the wreck there is a good chance that the driver will get off. It sucks, but the cops have the burden of proof in these cases and just because the truck belongs to a person doesn't mean they were driving.
I mean, the guy is fucked, but probably not that fucked. Let's hope he doesn't have enough sense or money to get a good lawyer.
A guy from my neighborhood flipped an SUV and crashed through a barn while drunk driving. His lawyer got him off because he got thrown to the cargo area during the wreck. They couldn't prove he was in the driver's seat because he wasn't in it when the paramedics got there and nobody witnessed the wreck. A few years later he was drunk driving again, flipped another SUV, and died. Sucks bad for his family, but he had his chance to change and he didn't.
Anyway...Similar situation. Lots of property damage, and that guy got off almost scott free. His insurance paid the bill for the barn. If nobody saw who was driving there is a good chance the same thing could happen here.

it was two guys coming back from Playmakers at about 2 in the morning. The guy who owned the truck was riding shotgun and the other guy apparently got selected to drive because he didn't want to take a cab. They stuck around for the cops to show up, but there was no ticket since they were on private property at the time of the incident. I didn't get to sleep until about 4AM that night because the officer didn't want me to go back to sleep until he had everything settled.
The WRX is mine, and the insurance company doesn't want to total it because the car is still worth nearly $20 grand due to how low the mileage is on it. That picture doesn't show how the C pillar on the passenger side is crumpled all the way up to the roof and that the frame is twisted. The car got knocked up on the curb about 5 feet. All 4 doors are fucked up and won't open, so I can't even get into the car to get shit out of it. the rear window's also busted out and the trunk is separated, so all the rain we're going to get this weekend is going to pour into that car.
What's really pissing me off right now is that the insurance company is claiming that they only have to provide basic transportation, which in their eyes is a subcompact Kia. Anyone that's ever seen me knows that my shoulders and legs are too big to fit into a Kia. They want me to pay the additional money to upgrade to the piece of shit Lancer I'm driving.
I need to just go get a loan taken out and buy a sport bike for the time being, as I'd been thinking about doing that anyway. If anyone knows of someone selling a good bike to learn on, drop me a PM. 7/29/2005 3:16:17 PM |

Dude, honestly, that car's totalled as a motherfucker.
I know the suspensions gotta be fucked because it landed on the curb that way.
Hell, look at the wheel on the Hyundai next to you - they think yours is better off? Maybe slightly, but the impact was worse.
Besides, all 4 doors being fucked, the windows popping, and potential buckles in the body are signs that more than just body panels are bent - that frame's fucked. I'd hate to see the welding and bending they're going to have to do to get that bitch back together.
I hate insurance companies - it would behoove them to replace that bitch/total it. I'd see what you can do about pushing them. Can you get a lawyer in this situation? Something's outta whack...

I think they will usually just charge the obvious person and see if a lawyer shows up to get them out of it or not. Usually if the person really wasn't driving they will roll over and testify on the person that was. Not many people will take a DUI charge for a friend.
I'm surprised the cops didn't charge the guy with DUI. Even on private property it is supposed to be illegal, but I would think that it would be classified as private property for public use (like a shopping mall) where they have full jurisdiction. Maybe it isn't since it is technically for the tenants and their guests.
Sorry about your car Eleusis. I wouldn't back down an inch until they told me they will total it. Also, take it to some places that aren't "preferred" by your insurance company.

I know it's beyond being totalled, but they won't write off on it. That car has a ring shaped reinforcement frame built into the C pillar for rollover support support and structural rigidity, and you can tell that it's damaged also. It's not like a simple frame to fix.
All of the other 3 cars in the picture were totalled by the adjuster as soon as he showed up, but they're dicking around with mine because of the resale value. I should steal engine parts off of the car while it's here over the weekend. I wish I knew someone that had an old RS, because I'd be all about an engine swap right about now.

theyll eventually decide its totalled, or spend more than its worth to fix it...either way theyre fucked and going to pay you a shitload. My boss got ran into in his corvette (which was less than a year old at the time) and they decided it wasn't totalled...by the time they got done fixing it, it costed them almost as much as the car was worth. Whoever did the estimate for that thing did a shitty job. They would have been a hell of a lot better off by just cutting him a check and selling the wrecked car at auction, but they tried to fuck him over and got fucked.

dont sweat it, they'll total it out eventually. a buddy got rear-ended in his WRX and the damage was no where near as substantial as yours and his got totaled. took a couple of weeks though.

OK, I think I'm getting fucked here. They don't want to total out the car because it lists for around $23,000. Instead, they've decided to do about $9,000 worth of body work to nigger rig it back into shape. The body shop guy sounded like he didn't want to replace half the stuff I asked about, such as the damaged wheels and the fucked up rear differential. He also tried to claim that there was no structural damage to the C pillar, even though there most definitely is. He estimates it will take over a month to fix the thing after parts get in.
How do I go about getting depreciation reimbursement for the loss in resale value this car is going to have to do it being wrecked before? I'm never going to be able to sell a WRX with a wreck on the title without taking a substantial loss. 8/3/2005 5:41:49 PM |

Loss of value is easy, but you have to ask for it after all the other repairs are completed.

I had been told that drunk driving on private property was illegal in NC, but that appears to be incorrect. Apparently, most states did not specify "on a highway, street, or public vehicular area" in the general statute and therefore it is a crime no matter where the offense occurs. When I looked up the law for NC it turned out that was incorrect. A cop told me that, but I guess he was mistaken.

If you want to drive drunk in your back yard or on your farm, that's private property.
