I'm on the topic but you are too knuckleheaded to take anybody's word. I suggest you go to the library or look up this information yourself. All your "topic" explained was your buddy's situation and whether or not people agree.

Well Reginald.... I DISAGREE!

can discharge an employee at the will of the employer for any reason or no reason at all."

"Punishment prohibited by the Eighth Amendment to the Constitution. Cruel and unusual
punishment includes torture, deliberately degrading punishment, or punishment that is too

Nothing about being terminated for violating a direct order from your employer calls under the
definition of "cruel and unusual punishment"

No, it's Latin for "it does not follow." Your comment preceding my post did not follow any sort of logical progression of the issue at hand. Just because many people have incriminating photos online does not mean it is a smart thing to do, or that their activities are any less illegal simply because "everyone is doing it." I'm afraid you're not going to get much sympathy for your friend's "plight" around here.

This is why i don't live in the dorms, but anyway

I don't agree with them using this board like that. This is supposed to be a haven of sorts to express opinions and feelings and spend a while just enjoying doing nothing important. Everyone needs time to relax without fear of someone finding out what she/he does in their spare time. However, if you read the "rules" you'll see the mods tell you not to say stuff that could get you in trouble because [implied] they do work willingly with various authorities. As with any employment, speaking out against your boss can be considered a conflict of interest. It's not unusual for people to be terminated in such situations, but if the boss happens to be proven wrong by a court of law, they have to give the terminated employee the job back. (I think that's right. I worked with someone who went through that.)

When it comes to the alcohol violations, if you're underage you shouldn't be stupid enough to get your picture taken with a beer in your hand, or even a can/bottle in your hand regardless of what's in it. If you have underage people at your party, you shouldn't be stupid enough to take pictures with a beers in their hands, or even a can/bottle regardless of what's in it.

again, not in North Carolina. Unless you have a contract to work that specifies a period of time that you are guaranteed employment, you can be fired at any time for any reason other than those that are considered discriminatory based upon sex, race, etc.

your boss can fire you because he doesn't like your tie if he so desires.

I'm not sure if this person is an alias or is legit. Doing a good job of trolling if an alias ... if legit:

-With the first post, YOU set the precedent for other people who post to this thread.
-You lack the so-called "facts" you ask others for ... you make vague references to policies, laws, and the US Constitution (wtf?), but no links are provided, no quotes given, etc. etc.
-You do not respond to serious/legit posts (mawle427), and are lured into a childish name-calling war.
-It is not the job of other posters to find "facts" to backup their opinions. It is optional that they provide facts. You can provide facts of your own, and hopefully prove them wrong ... it's called intellectual debate.
-I am not trying to be insulting, but it looks like you took little time to post something thoughtful on a serious matter.

ANYWAYS, provide us some links to the employment contract they signed when becoming an RA, precedent cases at NCSU, university housing, university policy, university student conduct, NC law, NC precendent cases, etc. etc. Then I'll be glad to discuss the matter with you.

That's a naive way of looking at it. It doesn't work like that in practice. It's not that the employer is going to be arrested for it, but he will get sued and his company will get smeared. Although the company may likely win the suit, the case will be heard and the company will lose some of its good name.

Thats the bottom line. Thanks to that RA and the clowns at student conduct, these students have learned the importance of not getting caught. It's not about whether or not they drank underage, we all have. It's about another notch in Bostian's and Cousins' belt.

employer might get smeared...might not. maybe if it was over a tie, but over insubordination...nope, they'll just demonize the person who got fired. most people dont have the money to drag someones name through the mud for the hell of it either (assuming it is likely the employer will win).

"FIRING someone for expressing their opinion is cruel and unusual punnisment and goes against UNITED STATES CONSTITUTION."

wow...the sheer level of ignorance expressed in this oppinion is just unbelievable.

Quote :
"
Amendment VIII
Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted.
"

http://caselaw.lp.findlaw.com/data/constitution/amendment08/05.html#1

first, it only covers criminal cases. second, the only punishments deemed cruel and unusual so far have been:

Quote :
"but it is safe to affirm that punishments of torture [such as drawing and quartering, embowelling alive, beheading, public dissecting, and burning alive], and all others in the same line of unnecessary cruelty, are forbidden by that amendment to the Constitution.''"

AND

Quote :
"Divestiture of the citizenship of a natural born citizen"

which is basically banishment from the US and revocation of citizenship.

Quote :
"Now he's on the verge of losing his job, his RA position, because he expressed his freedom of speech and it went against University Housing policies of employment"

NC is a state where employment is completely voulentary. If you agree to a company policy when you're hired then subsequently break said policy, the company can terminate you without consequence. As someone said earlier, only way your buddy could get anything out of being fired is if he could prove that he was fired based on race, religion, age, gender, etc. I'm doubting even a sensationalist such as yourself could drum up a story about that...then again, you apparently don't understand the constitution so it wouldn't surprise me.

once again I'm baffled at the raw ignorance expressed by many students over these issues. So far nearly everyone who's tried to stick up for the people caught drinking, or RA's who are getting in trouble or tried to bring Paul Cousins down for doing his job have not only been wrong, but they've expressed complete and total ignorance about how the system works. Are NCSU students really this sheltered? Do they really feel entitled to do whatever you want and damn the law, rules and consequences? It just baffles my mind that a group of people who are intelligent enough to get into college can be this ignorant of the real world. You don't post incrimnating pictures on the web, you don't have a dick waving contest with someone who has more power than you, and you don't badmouth the organization that you work for. These all seem to be common sense to me...

I haven't read the thread so this may have been pointed out

but in NC you can fire anyone for any reason as long as it is not race, religion, age, or disability.
