Yesterday my frind got rearended, completely the other guy's fault, on the way to a class. My friend's license was suspended back a few months ago for 100 in a 35, but his lawyer sent him a temporary license or some such that said that he could only drive between 6 am and 6 am (that's not my typo), unless he was on the way to or from work. Since my friend technically wasn't driving to or from work, he debated whether or not he should call the cops. The damage was fairly minor, but it was pretty hard to tell since it was dark and rainy, so we called the cops anyway. The cop gave him a citation for driving with a suspended license and now he has to appear in court.

What would you have done?

yeah but it wasn't really an option yesterday for him to go back in time and changed something that happened a year ago

You said he was on the way to a class, right? If he's a student, then going to/from class should fall under the "to/from work" exemptions of the suspended license.

yeah that's kinda what he tried to tell the officer, but, as we all know, anyone under 30 trying to communicate with a police officer is really just "smarting off"

he should just explain to the judge/magistrate that he was going to class.

Did it by any chance happen on campus or in any of the immediately surrounding areas? With a class schedule printout and a reasonable judge/DA, he shouldn't have any problems getting the citation dropped. But he shouldn't expect too much sympathy, I mean the sumbitch is lucky they didn't throw him under the jail for 100 in a 35.

yeah it was near campus, but techically it was SI, not an actual class that he was going to, so who knows

he should have been carrying that piece of paper thats the limited license and it does say on there you can drive "for education purposes" outside of the normal day driving hours

show that to the cop and there isnt shit they can say

he showed it to the cop, but the cop apparently didn't understand it and seemed to be asking us what was meant by 6 am to 6 am. When the idea that 6 am unitl 6 am means all day long, the cop just said something along the lines of "well you'll just have to show that to the judge on your court date which appears at the bottom of the citation"

not called the heat, and settled with the guy, had him give your friend some cash or something.

There's no such thing as fairly minor collision damage, in my opinion. If a body man has to sneeze on it, it will cost $500.

And yes, I would have called the cops. Way too often, an insurance company will refuse to pay unless there's irrefutable (or at least damn strong) proof that their client is at fault.

I don't know anybody that carries at least a couple of hundred dollars in cash with them on a regular basis.

You've got to cover yourself...and I don't think it will be too hard to get a judge to back you on the temp license thing, though I may be wrong. Just be respectful as hell.

^ my grandpa carries about $800 on him at any given time, i found quite a few benjimans in a little compartment in his wallet before, doesnt trust the bank for a damn credit card or debit, and he hates writing checks

it's all in the way you talk to cops. I've been pulled 14 times and only recieved 2 tickets. If you talk like an ass you will get treated like an ass. I've sinced calmed myself down and haven't got a ticket in over 5 years

right, and i've been pulled twice for fairly minor violations, been extremely respectful, and still got a ticket each time.

If your friend has a lawyer, then thats who should be handling the situation.
