I was recently in a car wreck in which I totalled my car and the other party's car. I was issued a citation for the accident (i ran through a red light) and I have to go to court this Monday. I am bringing proof of insurance as well as a letter my insurance company faxed me stating that they covered the other party's expenses. Once the court sees that my insurance company has taken care of the accident completely, will they drop the charge? Should I bring anything else to help my case? 3/1/2006 8:31:27 AM |

no, and no not being a jerk, but if ran a red light they is really nothing that you can do to help your case against the paying for the citation

nevermind...I called the DAs office and she told me as long as I have a letter from the insurance company stating that the other party's expenses were covered then I will have it dismissed and I won't have to pay any court costs or fines. 3/1/2006 8:50:55 AM |

Normally, the citation is about breaking traffic laws and has nothing to do with rather or not you have insurance. I'm willing to bet that you were cited for running a red light and failure to stop to avoid and accident. Those charge should stick insurance or no insurance. I mean, it would be good luck for you to avoid any traffic violations or criminal charges, but lets face it, you do deserve those charges. I'm not saying I dont deserve that traffic ticket, I was just asking a simple question. A lot of people have done dumber things that have caused accidents. It was a stupid, stupid mistake and I won't do it again. A lot of traffic tickets get dismissed to cut down on court cases as long as you can show that your insurance is handeling it completely. 3/1/2006 5:57:26 PM |

If you know a lawyer, it wouldn't be a bad idea to talk to him/her. Paying the fine isn't as much of a hassle as getting points on your license. 3/2/2006 10:34:14 AM |

Yea, generally the "failure to avoid a collision" tickets are dropped. However, if you were charged with running a red light, I'd be surprised if that was just dropped. 3/2/2006 11:21:17 AM |
