get a law passed that says court cases that get dismissed should pay a $50 administrative fee because his staff is so overworked from all of the dismissals


I hope this doesn't go through and if I had known this was coming through, he wouldn't have received my vote

how could that ever be justified - you get a bullshit ticket and then it gets dismissed b/c it's bullshit but you still pay $50 is crap

however getting a ticket for something like inspection being passed due and then going to court after you got your car inspected then it being dropped is bullshit also and they should pay $50

How about a law that says cops can't be fucking pricks anymore and charge people with shit that will never stand up in court.

This reminds me a lot of Brazil, the movie.

The government would arrest people and then make them pay the costs of their interrogation, even if they were innocent.

i'm thinking we need more details on this.

i would imagine the fee would be for people who bring charges, not someone who gets charged.

but if it is the case, that someone can be charged with a crime, then given a fee when the charges don't hold up and the case is thrown out, that would indeed be very fucked up.

I thought it for certain tickets only, like expired inspection/license and such. That is not a goverment screw up.

It does cost the taxpayers money for 60 seconds it takes to call the case, show the registration and have it dismissed. I imagine it takes the legal assistant a good hour to type the information into the court calendar. Would you rather have the burden of bearing the costs?

I was in Harnett County Court for just an hour the other day. We had 15 expired inspection dismissals in that small amount of time.

the 50 dollar fee should go to the asshole cop that wrote the bullshit ticket

I read the article and pretty sure it just applies to expired registrations or licenses.

Yea - that's my impression. It's not like if you go and are found not guilty, or get it knocked on a technicality, you still have to pay. The only people who have to pay, as I read it, are those who are guilty, but got the problem fixed before their court date so the office drops the ticket.

i would be down for this if it is the cop who wrote the ticket that has to pay the fine. i think that would be fair.

I know, but that's stupid too. Either drop the ticket and don't make him pay shit. Or find him guilt and take a hundred some dollars from him. Otherwise, it's a joke.

so they're basically lowering the penalty for having an expired license/registration to $50. (unless you're REALLY expired, in which case you pay the full ticket amount -- presumably more than 50).

^No, not exactly. It also won't be attached to your driving record because it's been dismissed. If they take money from someone ($50, in this case), I wanna see some shit on their driving records.

I just don't like this "dismissal but we're still gonna take your money" attitude. It doesn't make any sense.

I also don't like the "oh you didn't have it inspected before but you do now? you're fine then" attitude. Many of the people who don't get their cars inspected and registered and insured and whatnot are displaying some serious anti-social behaviors. It's not like they're potheads who disagree with the drug laws. They're straight up saying that the rules don't apply to them even if breaking those rules hurts the people around them. There's something wrong with that outlook.

Nonmoving violations might not go on the driving record or make a difference insurance wise (depends on what it is)

It will be on your criminal record..... but it does not mean anything really

It's been said already, but yeah if you're reponsible for a bullshit case that gets dismissed then YOU should pay for it. Stupid cops and frivolous lawsuits would fall into this category...
