It's very simple. She was not a covert agent at the time so no crime was committed.

This will be interesting. Will a civil court have access to the classified materials necessary for a civil suit? Also, since civil courts have a lower threshold, it will be interesting if Rove, Cheney, and Libby will dodge it here. If they do, then there really is no way for Plame to hit them.

Former spies who make themselves public figures by aligning themselves with political campaigns should not be able to hide under a law which was designed to protect spies in active duty (not Plame). I believe the author of the law in queston has even spoken out exclaiming that the law does not apply to Plame's alleged outing. Anyway, if the law was broken obviously this prosecuter would've grasped onto it by now, I guess yall need to enlist Nifong for the cause. He'd get it done.

This is in CIVIL COURT... The law in question does not even apply. There are several torts she could bring. In civil court, the burden of proof is lesser than a criminal trial. Also, classified documents can be subpeoned within reason and I do not think executive privilege will extend to smear campaigns.

Her husband disagreed with the administration about evidence of uranium and they ran a smear campaign as a result. Her idenity was irrelevant to the issue at hand.
