Does this seem like a decent contract if I'm selling something to someone that isn't local?
This invoice is in regards to an agreement that has been made between Douglas M. Currier and Renee Erdman.
-------- Agreement --------
I,
Douglas M. Currier, do hereby agree to provide Renee Erdman with a Queen size bed package (mattress, frame, and boxspring) for the price of four hundred dollars in United States currency.
I,
Renee Erdman do hereby agree to provide Douglas M. Currier four hundred dollars in United States currency for a Queen size bed package (mattress, frame, and boxspring).
Both parties agree to these terms and conditions. All sales are final. Both parties agree that this is a legal and binding document that may be used in a court of law.
Addendum
Douglas M. Currier is responsible for returning all funds to Renee Erdman within three business days of pick up if the quality of the package does not satisty Renee Erdman.
If said funds are not returned within three business days, Douglas M. Currier is subject to any and all legal recourse that Renee Erdman is entitled to under the binding laws of this contract. 8/8/2006 4:50:38 PM |

you need names, a date, object being conveyed and a price for it to be legally binding...slap a date that the transaction will take place and you're good.
(think checks are legally binding--what do that have? name, object, date, and amount)

I would add something that says this document embodies the whole agreement. Basically saying that neither party can come back and say they agreed to something outside of the document. It is called a merger clause.

Does the buyer want a contract?
Honestly, you do not need a written contract for this transaction. A verbal agreement is just fine. However, if you want an a written document, add elkaybie's terms and clean up the return policy.
Honestly, for a contract to be binding for the sale of goods, you just have to have a quanity listed. Courts will impose all other terms (price, time for transaction) ete. You might want to add a No Oral Modification clause which requires any subsequent agreements to be written. Although the sale of a mattress should not bring up such problems. 8/10/2006 9:29:05 AM |

Actually, you could go to small claims court w/o an attorney, but I imagine this deal will be cut and dry and you just want to protect yourself from a 5% chance of this lady being a crook. 8/10/2006 8:16:40 PM |
