this may be worth a shot, but i'm no lawyer: write up a petition stating that you informed all the neighbors beforehand of what was going on, and that they agreed it wouldn't be a nuisance, then have them all sign it. i'm not sure how well (or if at all) that will hold up in court, but it couldn't hurt

also, this violation will be thrown out in court
Raleigh needs to start policing the police better because this shit might end up as a lawsuit one of these days.
Also, the police need to have a decibal reading in order to fine you. If they never measured the sound then they should not fine you and you should levy a misconduct report against them

my advice is if you have the time, fight it....i fought mine and got it dropped, but it took like 4 trips to the courthouse before i was even heard by the judge
if you don't feel like going to the trouble, take your 10 hours of community service and be done with it....even then, you have to go back to court at least once to verify your service has been completed. 8/23/2006 10:11:51 AM |

^ not everyone can get off work or school multiple times to go sit in the courthouse for the better part of the morning...that's why i suggest if your job is inflexible or you have a class conflict, you may want to reconsider fighting

actually, your work is required to let you out as is school.
and for something like this, it would be dropped instantly since there is no decibal reading and the violation ocurred during a time in which the oridnance is not in effect.

the cop wrote the citation on a traffic form and checked the box for "Other". he wrote:
"Did host a party or social gathering which by reasons of the conduct of those persons in attendance resulted in excessive, unnecessary or unusually loud noise that disturbs the repose of the neighborhood. RCC 13-3017"
i think it's pretty much bullshit and should have been a warning at most. he told us straight up that his job is to ride around trying to bust parties and if he had to come to our house for noise disturbance again, ever, as long as we live here, that he will arrest us on the spot. Right now they are "making examples" of students. It won't work, and the Student Legal Services is already geared up to fight it. To my understanding (word of mouth so take it as you read it) there are 2 lawsuits about to gear up against the RPD for harassment.
I openly think RPD needs to chill the fuck out. If I had a party and police showed up and I didn't think it was too loud hell yes I'd ask for a meter reading. I've always followed the law but lately they've just been harping on every single thing. They are no longer acting as the protectors of the common citizen. They are acting like overpowered, beaten as a child, assholes. This does not apply to most of the old school cops. Just the new batch.
People will always find a way to rebel when overcontrolled.
- Put up street light cameras, people get anti camera plate covers - Clock people at the bottom of a hill and give them tickets, they'll fight you in court over entrapment and win - Ticket for noice when there is none, they's sue for harassment since you didn't have any evidence and win.

The noise ordinance states a very specific decibal reading. The only way they can tell that you violated that is through a decibal reading meter. If they did not write down the level of the reading then he has no grounds for writing a ticket.
