Does anyone else think it is rediculous that with the DUI laws you can now get a DUI for riding your bicycle drunk. I think this is absolutly rediculous. If anything it should be a safe alternative to driving and be encouraged to keep people out of the drivers seat.

I can somewhat understand the rationale behind the law, howvever, i think someone driving a bicycle drunk should be charged with a minor infraction (i.e public intoxication, reckless endagerment). Driving a 3000 lb car is a whole magnitude more dangerous then someone biking down the road at 15 mph. With the current law though i could still get a DUI with the same legal complications also effecting my car insurance and driving privlidges.

from teh way i read it, it sounds as if only those under 21 would get the dui on a bike.

It was in the same paragraph as the underage drinking, now is only illegal to possess but not illegal for it to be in your system? I think I took it that way because its illegal for those under 21 to even have a .01 alcohol content if driving, and then they used the term 'finally' implying something that wasn't already under way. I only skimmed it so i'm probably mistaken.

Maybe if the horse was drunk too, otherwise they have self avoidance built in!

As for the rest, they move too slowly to consider them a lethal threat.

No its not ridiculous. A bike is just as dangerous. If you swerve out into the road and someone swerves to avoid you, causing them to wreck then you are doing just as much damage as a car. I dont think MADD is the one whining here...

If they're going to increase penalties for infractions then the city should have a better public transportation systems set up downtown on nights and weekends.

I wish they had a service where you called a phone number and a vehicle came and picked me up and then dropped me off at the place I live.

Better yet, don't get drunk in a place where there is a high likelihood you are going to get mugged if you don't have a ride home and can't afford said service.

** p.s.- I think it's dumb to have the same punishment for DUIs bikes and cars if that the case. I don't know the NC law because I don't have to...

Um, taxi anyone? This thread is about Bike DUIs. If I see someone riding a bike home from Glenwood South at 2am on a Friday I might purposely try and hit them for being an absolute douche.

I think they should just install a 3rd lane in the road that is 50 feet wide so that we can all drive home drunk in our cars. All the street signs should say "Blurry Road Ahead" and you should be required to have a navigation system that yells at you.

To my mind, the issue is less one of alcohol and more one of certain bicycle nazis always trying to claim that their vehicular rights and responsibilities are exactly the same as those of motorists -- except, of course, when that inconveniences them somehow.

^^I agree. I can't count how many times I've been behind slow ass bikers on two lane roads. Then they'll say stuff such as "a bike is a vehicle, the road is my road to". Of course shortly there after they will come to a traffic light on red and go right on through.

So if I get pulled over for driving my riding lawnmower down Western Boulevard at 2 in the morning and I am drunk I won't be charged with anything? Not even a traffic violation for, I dunno, driving a riding lawnmower on a public street?

It is a vehicle, but it is also supposed to follow the guidelines of a slow-moving vehicle such as driving as far right in the lanes as possible to allow other cars to pass them.

They aren't talking about bicycles, they're talking about motor scooters than can move up to 40mph! It's a motor vehicle that has enough weight to kill someone either by being struck or if a car hits them it can do enough damage to cause death etc.

A bike moves an average of around 10mph. A drunk person is probably moving about 5mph and easy to dodge. Take the same person who holds a pedel or handle for gas... and well they can easily move max speed without knowing it.

What about keg registration, which is one of the new laws? Great idea, right?

Hey, now that we have the names of the "party people," why don't we send the courtesy patrol by their houses to, you know, check on them. I mean, with all that alcohol available we want the drinkers to be kept safe, right? We should conduct these inspections for the greater good, of course. And while the courstesy officers are at the homes, they can do a quick inspection for other harmful substances--like marijuana, caffeine, salt, and so on, right?

yeah i think this is complete bullshit and the biggest reason i oppose the keg policy. Also, i disagree with the part of the law where an officer with "reasonable" cause can screen an underage person for alcohol. This is seriously some gestapo bullshit. I thought the purpose of the new bill was to deter people from drinking and driving. These additional clauses almost borderline on a infringment of basic rights and is a severe increase in the power of gov't. I can already see the ALE agents randomly grabbing students at random to give them a breathlyzer as they enter carter finley stadium next fall.

omg 19 year olds drinking its the downfall of society. i am glad i'm 21 and don't have much to worry about. i just feel bad for my underage friends.

And guess what? According to a discussion I heard on NPR (so it must be true), Americans actually drank more alcohol than in any other time in history during the early 1800s. (I heard this during a discussion about Edgar Allan Poe possibly dying of rabies.)

So, as a society, we are actually doing better than in years past. Why all the fucking laws?

And another thing: What happens when people start substituting away from the newly regulated keg products to the comparatively unregulated cases and mini-kegs of beer? Will the all-knowing legislature limit the number of cases of beer one can buy? Mini-kegs? Caffeine? And anyone that says this type of thing can't happen is in fucking denial--shit, it's already happening. Where's my America?

People weren't operating motor vehicles in the early 1800s. Also, the fact that there were a lot of drinkers and drinking in the early 1800s isn't particularly surprising or telling. I don't think anybody's saying our society has a drinking problem; they're saying we have a drunk driving problem.

I do agree that new laws aren't needed. They just need to enforce the old ones. This is a political move...?

Not that I'm a big fan of keg registration, but it helps you track down who allowed someone to get blasted and then drive off.

I don't think it is anyone's fault except the person who kept drinking (unless forced, of course)
But that is the reason it gets mentioned.

I'm telling you, the cops are already doing a lot of fucked up shit. Spotting parties and waiting outside to bust people--and even coming up to the door claiming a noise complaint has been called in, which is often a lie. And the list goes on.
