here is the situation.
I was involved in a car accident with two vehicles.
I struck the car in front of me and he struck the SUV in front of him.
No one was injured and the po po was brought out on the scene to give me a ticket for failing to stop to avoid an accident.
My insurance company took care of the damages to the other vehicles.
Okay...so my court date is mid-January.
Right now i have the choice of paying it off through mail or by person at the court house and basically contest "Guilty" OR i can wait for the court date.

Question 1
When i go to court and contest "Not Guilty", would i have to give them a reason WHY i think i'm not guilty? I know that im guilty but 'someone' told me that if i contest "Not Guilty" then the court would give me a new court date in which case the officer that gave me the ticket would show up on that new court date to settle this dispute.

Question 2
Another question is.....that 'someone' told me that the officers seldom show up to these things because its such a minor thing and they dont wanna take time out of their lives to come to court for such a minor charge. is this true?

Question 3
Did i say something wrong? like....are any of the court procedures i mentioned wrong?

the cops almost always come to court

and if you plead not guilty your trial will be that day, be ready

disposition court they will most likely either just assign you a new court date in district court no matter what or offer you a reduced plea right there.

In district court, the officer does have to be there or the state must continue the case...the state cannot continue the case more than 3 times. You can also continue the case 3 times, so you can go to district court and if the cop is there get it continued and see if he shows up the next time

you can ask your insurance company to sent you a letter stating that they have paid for the damages and bring it to court. show it to the clerk on your court date and it should be dismiss. i think its called letter of liability.

They are not allowed to represent you in matters against state or local govt. They will tell you that there is a conflict of interest and then give you the contact details of a few local attorneys that can assist you.

You need to then contact one of those lawyers.

(I think the office is in Talley)

cool...i have already obtained this letter and is planning on presenting it to the court.

OO antther question.
When i go to the courtroom, are they gonna ask me guilty of not guilty before i get a chance to hand them the letter of liability?

the clerk will pull your citation, read it and ask if you have a letter to show, show it and the clerk will pass all documents to the ADA and he will read it, ask some questions, he will determine whether to dismiss or not, so dont take my word that it will be dismiss.

Generally these tickets are dropped. It's just collateral to make sure you take care of things. When it happened to me, I went and talked to the ADA in advance and told her that I had taken care of my responsibilities and she dropped the ticket.

yeah, as long as you have the letter that shows that your insurance took care of the damages, it should be dropped, at least that is what happened in my case way back when...

i dunno...i turned the page over to the client and they've been making a few updates and changes since i let it go

it could be i forgot to add it...aha...

i'll make a note of it and check on it when i get back in raleigh

So if I show up to court at asscrack, what are my chances of seeing the ADA, and from there what are my chances of getting it reduced to a nonmoving?

i've noticed that the wake county disposition court is the busiest as soon as it opens and the last hour and a half before it closes....so try around noon...it might not be as hectic

You just either really f'd yourself, or you have really confuzed me about what you think you are not guilty about
