I am not fan of McDonalds but once again frivolous tort lawsuits strike again. $6.1 million is fucking ridiculous.

no, the jurors see a large, faceless corporation and figure they can afford to pay this "poor little girl". its fucking ridiculous. especially when people sue things like a city govt. etc when the stupid jurors don't realize that the money they are giving these people is coming from them via taxes. the majority of people are just stupid i guess is the point i'm trying to make.

and i'm sure mcdonalds will appeal, if this girl every does get this money it won't be for several years, drag it out as long as possible. hopefully and appelate court will tell this girl that she's an idiot that needs to be sterilized so she can't pass on this stupidity.

people should be able to sue for whatever for they'd like. it should be up to the judges/juries to decide what cases are worthy of trial and if found guilty, what sort of award should be given. broad-stroke limits on courts invariably have unintended negative consequences.

and just a sidenote: should the duke rape case kids be able to sue for $30 million dollars or is that an abuse?

i'd still like to know some more details about the background of the series of incidents...obviously they have a 3.5 hour sexual assault on tape and the guy is serving 5 years...but i'd like to know more details about what happened across the country at other restaurants, if the same people were responsible, etc...clearly the fact that the assistant manager, an employee of mcdonalds, was involved mcdonald's has some type of liability...but the way the story explains stores being "struck" all across the country is unclear

^i think the duke lacrosse students should definitely be able to sue the university, but i think they were a lot more at fault than mcdonalds...what i specifically mean is that i dont think McDonald's Inc. knowingly hired a sexual predator or whatever you want to call the assistant manager, even if they're liable...but Duke did choose to suspend them and there certainly wast a videotape of the rape...also they should be able to sue nifong that money since he seemed to be the most responsible in dragging out a relatively open-and-shut case (witholding DNA evidence, among other things)...but the culprit doesnt always pay their fair share

course it sounds like the mcdonalds case was handled properly through the legal channels to some extent early on...no evidence of a politically motivated district attorney with an upcoming election

I worked at McDs for six fucking years, if anybody had called my store I and EVERY single one of our employees would have laughed at them and hung up the damn phone.

hmm. i seem to have been mixing that detail up with something else.

but still.

the McDonalds *manager* was aiding and abetting in this crime against her employee, and this sort of thing had happened to a number of McD's across the nation.

McDonalds has some responsiblity to alert their managers to this sort of thing, and do a minimum to ensure that it wasnt allowed to go on unchecked.

Yeah, the gal is naive, to put it nicely, but i can see how this might happen to someone who had lived a sheltered rural lifestyle, then all of a sudden be threatened with arrest and loss of employment, no matter how ludicrous it sounds to you and me.

in any event, McD's is liable for the protection and safety of their employees, especially against from attacks by their manager (whether it was direct, or by proxy)... and ESPECIALLY from a known attack that had been attempted a number of times at a number of franchise locations in the recent past. That this was able to happen is criminal on the parts of the perpetrators, and NEGLIGENT on the part of McDonalds Corp.

I dont care if that gal is a country hick straight off the farm with an IQ of 80 and a 6th grade education .... is rape and abuse, and the resulting shame and inevitable social ostracizing brought to her and her family from the community, worth $6M?

yeah, i think so.

and mcd's fired him. what more do you want? do you REALLY think that McD's should go up to all of its managers and say "Hey, there's a guy calling around, telling McD's managers to make their employees suck the manager's dick. It's a hoax. McD's does not endorse the forcing of employees to suck the manager's dick. Oh, and put a little more salt on the fries."

The fact is, this manager was a dickface. And McD's fired him. Even if McD's had said to him "Hey, don't ask employees to suck your dick" (which they more than likely did anyway through sexual harassment awareness training, btw), it's likely that this asshat would have still been a douche and done this.

You could make a case that McD's should hire better managers, and I can't disagree with that. However, hiring procedures are not perfect, and bad apples slip through. I don't really think you can make a personality questionaire that says "Do you think it's OK to ask employees to suck your dick in response to allegations of theft? Yes/No" Really, that's asking too much. McD's fired the guy, and that is the appropriate response. Now, if the manager had a history of sexual misconduct in the workplace at McD's, that would be different. it would also be a different story if multiple managers had asked their employees to suck their dicks (or whatever the "performed sexual act" was) in response to this hoax. But expecting McD's to contact all of their managers and say "this is a hoax" is pretty stupid. A Manager of a fast food restaurant should be able to tell that it's a hoax, and if not, he should be fired. And that's what McD's did.

End of story.



But, if you really want to get picky, then I would counter with the fact that McD's restaurants are not generally owned by the McD's corporation. Thus, a particular location's hiring practices and managerial oversight is not something that the corporation can be reasonably expected to control. Thus, McD's shouldn't be held liable in this case; rather, the owner of the individual franchise should be, in addition to the idiot manager. Buuuuuuuuuut, who is the dumb bitch suing? Oh, right, the people with all the money... Open. Shut. Case. Except in America, where responsibility and common sense are now crimes.

McDonald's should have warned all employees of this risk. But it didn't. The thing is they're so on top of all the shit that their handbook is this hyperdetailed guide that it is to be used at all times. Every situation is included in the book, and employees have to follow it to the tee or risk losing their jobs. They eventually become machines...so when some real, crazy ass shit goes down, they don't know what to do.

And I don't know if this is the same incident...but that girl had a broom inserted in her...6.1M sounds about right.

This corporation has no face. There are rules for absolutely everything. Their employees don't know why they do what they do. If they have a question about their jobs, they ask the person who asks the person above them who asks the person above them, and if that person thinks the question is legitimate, it will appear in the next handbook. Shit like what happened to this girl happen at these institutions for a reason...because McDonald's employees are vulnerable to this shit. McDonald's should be prepared to face the fucking consequences when their business model doesn't work out like planned.

The irony here is that all this incident will do is cause McD's to put yet another line into its "hyperdetailed guide." If McD's were able to say "Hey, dipshit, use your fucking brain and don't do stupid shit," then, by your logic, this event could have been prevented. Of course, all of this assumes that McD's has any level of control over the hiring practices of individual franchises, which it doesn't. The best it can do is put out those manuals, which franchise owners buy. And I am SURE those manuals cover sexual harassment in the workplace, and I am fairly certain that one should reasonably take from those manuals that inserting a broomstick into the orifice of a female employee at the behest of an anonymous caller is NOT appropriate.

I think the question asked above is still a valid one: if instead of asking the manager to rape an employee, they instead asked the manager to kill the employee, and then did it. Is McDonalds still liable in your eyes? If not, why not?

I suspect we only know this caller called other McDonalds because this case actually led to crimes sufficient to make public headlines. Suddenly, managers across the country called the press and said "Yea, someone tried that here, I laughed and hung-up. I didn't tell anyone before now because, well, what kind of idiot rapes a girl because someone on the phone asked them to?"

The manager and fiancee should be locked up for far more than five years. But no one else should be punished for the actions of criminals that showed no prior signs of misconduct.

The girl in that pic looks 12 years old to me, not 21.

This is clearly a case of her going after the deep pockets though. She could have sued the guy in jail, and likely won, but really wouldn't have gotten anything except practically ruining that guy's life (since most of his paycheck would go to her).

Now, she gets 6 million dollars, but the guy's only in jail for 5 years.

What really kills me about this is that Summers was awarded $1.1 million despite being convicted of a misdemeanor related to the whole mess:

Also, this particular McDonald's was owned directly by McDonalds--not a franchise.

McDonald's does have a rule against strip searches in their restaurants.

Ok, I have been swayed. McD's deserves to lose; I now know the company had been warned before hand and neglected to notify its managers. Case closed.

BUT THE FUCKING MANAGER GETS $1.1 MILLION!?!? She is profiting off her own criminal activity (strip searching someone against their will is a crime, whether you knew it or not)!!! That $1.1 million, plus everything she owns, should be awarded to the victim in this case.
