no I was burning wood in a rock ringed fire pit I had dug in my backyard
lately I've preferred to grill on wood because it is more flavorful

I figured it was safe because it has rained for the past 3 days or so

state wide burning ban apparently, though

nobody told me

that's the plan

the marshal said if I'm lucky I could get it knocked down to $250

but one of the firemen mentioned that cooking food is the only loophole
I'll look up the law after dinner

unless someone wants to be nice and find it for me

^^^ i didn't read the whole document but that section didn't say if applied during a burning ban. That exclusion only applies to burning within city limits.

the statewide burning ban allows food to be cooked, but its also broken down by town, city, and county. So, you'd have to see if your areas specifics are regarding the food/warmth thing, as some have an all open burning ban, and some just follow the state regulations.

that really sucks though, hopefully the loophole will work.

Its because it was on the ground... if it was on a grill, that would be different. I doubt you will get out of it, maybe reduced but that would be all.

its probably my fucking hood rat neighbor who was always coming over trying to get free beer off of us

here's a response I've gotten from the fire chief

so... if I google "asheville burning ban" the first link is an out of date article saying "Asheville Burning Ban Lifted"

then another link to the MountainXpress (the first result)

then the Citizen-Times saying that the ban is still in effect

then I'm going to offer to help inform students and people my age about the ban and fire safety

The statewide burn ban has no affect on you unless you let the fire escape.
If the fire marshall gives you a ticket then it means they've extended the statewide burn ban into their jurisdication.

Sounds like the local municipality did a shitty job of informing people of the ban within 100 feet. I know we did a shitty job of informing people of the ban in our jurisdiction.

i got a ticket for the same thing yesterday. and the same lame-ass excuse, that i should know about the drought in the rest of the state.

but it has rained in boone.
every. single. goddamned. day.
for the past week.

the fact that i had to look pretty hard for wood dry enough to burn should be a reasonable excuse for not realizing a burning ban is in effect.
