This happened to me earlier this month. It sucked mightily, but I got a new car. Good luck man, make sure you are persistent and don't back down from what you want. If you got rear ended you have all the leverage here and you should be sure that their insurance company knows that you know. If they try to put you off the old, "if this is handled by [insert deadline] you won't be dealing with me you'll be dealing with my lawyer" line usually speeds the process up.
