My roommate and I moved into the apartment we live in now about three years ago. At the time, ING owned the property, and handled the leasing. We both signed the lease, and all was good.

About a year and a half ago, ING sold the property to another company. They since told us that we are on a month to month lease that they can terminate at any time. Furthermore, as I found out this week, the new owners/renters along with my roommate are telling me that my roommate is now the only person on the lease, and that I am just a "roommate".

wtf??! is this legal? I never signed anything saying I was releasing my responsibility or my name off the lease. I'm really confused.

It's their fault and you can legally sue for damages up to $10,000.

sounds like a paperwork mix up and it could take years in court to see any results.

They can terminate you at any time but they can't change the contract you signed without notifying you.

Well, considering that they have been there for three years, is seems likely that the original lease expired, making it a month-to-month. So, they should have the right to kick both of you out with 30 days notice; that they are choosing to only kick one of you out with 30 days notice is strange but seems well within their rights.

Did you ask if you could simply sign a new lease--probably in the 6- to 12-month range--with both of you listed as co-lessees?
