well my uncle and dad have "longest liver" rights to it...
but then it goes to me...they already have signed ownership rights over to me....but the tax stuff is still in their name...
i'm probably going to be putting it in a conservation easement in order to keep my broke ass cousins from getting it if i die before i have kids and selling it off or putting a trailer park on it 3/23/2008 2:07:17 PM |

ok so i close tomorrow on my lot and i want to clean it up on saturday. there are bushes that were planted on the other side of my property line a long time that have grown over on to my side. i dont mean they are hanging over. they are actually growing out of my property. so i call the guy that owns the lot beside mine (vacant and has been forever) and told him that his bushes have grown on to my property and i wanted to get them cleaned up and this is what he told me.....
"i can't control what you do on your property but I'm warning you, you better not encroach"
and i thought i was being nice by calling him and telling him. worst part about it is he is a lawyer and he is OLD.
what would you guys do? 3/25/2008 7:30:03 PM |

I didnt look too hard, but google gave me this:
Quote : | "Other problems' arising from tree branches is the neighboring dispute of limbs from one property trickling over onto another's. Branches looming over one neighbors yard from another may automatically make the infringed neighbor take action and trim the tree limbs back out of his property space. Unfortunately, the neighbor can't just cut off tree limbs and chunk them back over the fence. The only way the neighbor can justly trim back trees is if the trees are prohibiting use of or destroying the property. Examples are branches shading garden space, and branches posing a threat during winds or storms; the branches are close enough to a window of your house that they could crash through them during a storm. If tree branches cast a shadow in your yard from a tree stricken with disease the owner should be notified of the condition of the tree so that efforts to eliminate weakened branches from your yard can be done. If nothing is done you may remove the limbs yourself from your side. Trimming limbs from your neighbor's side without permission is trespassing. The only time you can legally trespass to chop down branches or cut down the tree is in an emergency such as fire where a branch a-flame can set your property ablaze. " |
This seems like it would be a state or maybe even a city issue. Start calling around before you do anything.

An older fellow who's judgment I halfway trust told me that any limb hanging over your property is yours and you have the right to cut it. My neighbors have a tree that dropped a ton of acorns on my car and dented it up while it was parked in my driveway. I'm considering sending a tree service up there to drop all the limbs that hang over my property before next fall. When I get the chance I'll search out the statutes and make sure it's all legal before I go talk to the neighbor and "ask his permission." I'd appreciate it if you post any info that you find here just for my own benefit. 3/25/2008 8:26:18 PM |

ill keep you guys updated. the bushes are growing out of my property and his (basically half and half). i am going to pull a string from stake to stake and cut all the way up to it. I will document all of it and take plenty of pictures. I think im going to call him and ask him to meet me out there and record the conversation since he was such a dick the first time i called.
^ I would too but when an opportunity comes to make some money i think i can deal for a couple years.

i guess it's a little too late to do this...but i would have seen what the cost of having them removed professionally would be...then have the seller deduct that cost from the price of the lot or the closing cost at least...
that's what i did when i bought my house....there were several things that needed to be done....the seller had most of them fixed but what he couldn't get taken care of by the closing date he just deducted for...this is the same principle...
this is something the seller should have taken care of before listing the land....unless it was listed 'as is'...
as for the man with the bushes....tell him either you or him are going to dig that shit up or he can pay you for that land...if not you'll report him...
i also had a semi-similar issue with a parking spot once...i was blocked in my parking spot so i drove through the neighbor's yard (like an asshole...i'll admit) and they just happened to be coming home at that time and confronted me about it...i apologized and went on my way....well my parking spot was half pavement/half grass....so i go to my car one day to find a note that said "If you continue to park on our grass we are going to have your car towed and report you for trepassing"....to which i replied with a note saying "if you continue to let your grass grow in MY parking spot that I PAID for I'm going to report you to the police for harassment, trespassing, vandalism, (and a number of other things i can't remember) then i'm going to spray Round Up on your whole fucking yard"....
i never heard another peep out of them...
in other words...there should be no issues about cleaning up land that belongs to you unless there is some sort of HOA type stuff to deal with....
