I need to know more about class action lawsuits.

How soon do you generally find out what lawyer is handling one? I was on a plane that had an explosion and possibly caught fire at 31k feet. This was on the 19th. I am not sure if I should find a lawyer or wait for a class action.

It was only 5 days ago, so I doubt anything has been processed yet if there was a class action. I'd imagine the lawyers would contact you... the more people involved the more they make.

Quote :
"GREENVILLE, S.C. -- An apparent problem with an air duct caused smoke to pour into the cabin of a Delta passenger plane on Wednesday afternoon, causing some terrifying moments for passengers and forcing the plane to make an emergency landing in the Upstate.

The Boeing 767 was filled with 259 passengers on a flight from Raleigh to Atlanta, but after the pilot reported smelling smoke in the cockpit, the crew made an emergency landing at GSP International Airport.

The plane touched down during rainy, foggy weather at about 5 p.m., GSP spokeswoman Rosylin Weston said.

Delta flight 1819 departed Raleigh at 3:16 p.m. and was scheduled to land in Atlanta at 4:07 p.m.

Passengers said the plane was at 31,000 feet when they heard a pop and then the sound of grinding metal from the cargo area. Then they felt heat.

"It came up right underneath us. Ashes came up," passenger Mark Meyers said. "There was insulation coming from the ceiling. It went from 70 degrees to 95 degrees. You sweat. You couldn't catch your breath. There was smoke in the back of the plane."

Meyers said that there was so much smoke that the passengers thought there was going to be an explosion, so they pulled out fire extinguishers and started spraying.

One woman was burned by the hot air that was flowing into the plane.

Myers said the crew prepared them for the worst.

"They moved all of us into the front third of the plane. We're sitting four and five people in two seats. They’re showing us how to breathe for a possible crash landing," he told WYFF News 4's Mandy Gaither.

Even though they didn’t know each other, the passengers held hands and prayed.

"The kids are crying. Their parents are calling. Grown men are crying," passenger Jason Tinley said. "When I saw the stewardesses -- really the anxiety on their faces -- they're trained for this, so I knew this wasn't some simple thing."

Meyers said, "A lot of people were upset, in tears, holding hands with strangers and a lot of people were resigned 'there's nothing I can do'."

As the wheels touched down, there was applause and relief.

"You see your life flash, it's true," Meyers said. "You see it all flash and you just have a resolution in your own soul about what's going to happen."

But the plane landed safely without incident and taxied to the B Concourse.

Delta brought in several buses to take passengers to Atlanta. Meyers said he felt the airline should have done more.

"Two hours ago we didn't think we'd be here to speak to anybody -- our families or anybody else. And now we're going through this with Delta Airlines," Meyers said.

Meyers said he decided not to get on the bus.

The woman who was burned rejected medical care.

Late Wednesday evening, investigators said that there was not a fire or an explosion. They said the incident was caused by heat coming out of an air conditioning duct that had collapsed.

When the duct collapsed, insulation fell out and heat from one of the plane’s engines then started blowing over debris, causing smoke, according to Delta officials. That was what triggered the alarms.

Bomb sniffing dogs were brought in to inspect the plane and found nothing suspicious.

The plane remained at GSP overnight and an investigation into the incident is continuing."

um, how in the world does that warrant a class action lawsuit?

If you were injured, they should pay your medical expenses (and im sure they are), but they got you there safely and unless there was some kind of gross negligence on the part of the airline, there's absolutely no cause for a lawsuit.

And yes, the lawyers would contact you.

The article says there was no fire and no explosion. That'd be scary as hell though. What are you looking to hire a lawyer for? Seems like there could be a case of negligence if Delta failed to properly maintain or inspect, or if this had happened before. If not, you'll be lucky to get reimbursed for a night's hotel and some free vouchers.

I need to know more about class action lawsuits.

How soon do you generally find out what lawyer is handling one? I was in a thread where a greedy girl was trying to sue an airline that had already compensated her for any inconvenience. She continued this pattern of stupidity by trying to sell said compensation in another thread on the same messageboard. This was on the 24th. I am not sure if I should find a lawyer or wait for a class action.

The voucher was because I was bumped ONTO the flight that almost killed me. They have provided no compensation for my medical costs and have not contacted me about doing so. I'd rather be pro-active considering the way Delta has treated me already.

I was going to use the voucher to travel to my medical appointments, but I no longer trust Delta so I'm selling it to help pay for those medical costs. Again, the voucher was in no way related to their plane almost killing me. Completely separate.

There WAS a very loud noise on the plane, smoke, fiberglass insulation flying everywhere There was not a second explosion, but there was a first.

I'd rather not have to be in contact with Delta anymore; I don't care if I have to pay someone to handle it for me. I can't take the stress.

they are only going to be liable in the case of negligence (aka they missed a safety inspection that caused it) which is ENTIRELY possible, and with all the shit coming out about airline safety recently, I wouldn't doubt it at all.

I would consult a lawyer just to find out if there is a suit, and to keep tabs on the cause of the incident. But otherwise, this is exactly why you have health insurance in the first place.

I'm really curious to know what things Meyers would have liked Delta to do.

maybe everyone thought they were gonna die, so they all whipped it out and started to furiously jack it. she got sprayed with some spooge and now she's preggers. that would be kinda embarassing, especially since nobody else has talked about the phenomenon

right on ralph! did they really do the whole cost-benefit thing that's floated around (i think it was in fight club) where they decided it was cheaper to settle the lawsuits than to do the recalls?

Sounds about like it's time for you to institutionalize yourself long-term, since you're so clearly unwilling or unable to deal with life.
