After Wednesday's sentencing, Durham was to get the rest of the deal -- calzones, lasagna, pizza and ice cream, his defense attorney confirmed. They will pay the tab.
Durham also got married Wednesday in a civil ceremony at the Portland courthouse. The wedding to Vanessa Davis, 48, also of New York City, was not part of the plea deal that will give Durham a chance for parole after 30 years.
Deputy District Attorney Josh Lamborn said Multnomah County Judge Eric Bergstrom made the right call in allowing the unusual plea agreement because it saved the expense of a trial and possible appeals." |

i hate it for all the people who are charged with crimes and have to defend themselves in an orange jumpsuit after sleeping on the floor and not eating well for however long

jail isn't supposed to be for innocent people, either. in other words, jail isn't supposed to be for people who haven't been convicted.
i can only imagine not being able to make bail, and preparing for trial from inside jail. that pretty much guarantees an improper defense and perpetuates the whole "guilty from the start" thing that the legal system/society has adopted.

me personally, i'd be a fair judge/magistrate- and i would base it on the guy's income and assets and potential for flight.
i'd have to know more about him to honestly say. but you know damn well that 1,000,000 dollars for a rich man is potentially the same as 50k for a poor man... especially in terms of what would secure that they show up for court.
sorta like when my father posted 25k for me. i sure as hell didnt want to go to court, but i would have rather been convicted of a crime i didnt do and go to prison than cost my dad 25000 bucks. reasonable bond all depends on the situation and people.

I see your point jackleg, but I tend to think that the problem with jail isn't the jail or it's workings. The problem with jail is the people that are in jail. If you lock a bunch of fucked up people in a small area it's going to be a fucked up place. There is very little that you, I, or the jail administrators can do about it.
But I've never been to jail, so what do I know?

did he turn himself in, whether or not he has a history of ditching court dates, witness safety, person(s) vouching for him, location during pre-trial release, etc etc etc
obviously if he has a history of skipping court dates, then he will likely forfeit his right to pre-trial release. you guys seem to forget that we're in 2008 and there are plenty of ways (house arrest etc) they can be sure he will show up, and not lock him in jail for 2 years while his trial is set up. 8/7/2008 10:35:50 AM |

don't get me wrong, i see your point jackleg. i agree with a lot of what you said.
it's very difficult to measure "potential for flight" though. i mean the guy could run off and live on the lam and then you spend $texas on a manhunt for a murder suspect.
but yeah, i agree, the system needs work.

My potential for flight is already a great risk and I'm not even on trial for anything (well, except a stop sign violation.) i know i base a lot of this off my own experience. some people can appreciate it, some people think its a grudge i hold. it's really not, though - because it ended up not hurting me cause i was lucky.
i just feel for the people who werent as lucky as me, and don't have anyone to help them. example:
in june 2004, i was arrested for felony hacking and placed on $15,000 secured bond. in may of 2007 the charges were thrown out of superior court. 3 full years later.
a whole lot of people dont have a way to come up with the 15% (2250 i think) to lose to a bondsman, and they certainly cant put up the whole 15k.
so, if my folks didn't put up that money for me, i would have sat in jail that whole time - without access to a lot of the information and stuff that was helpful in proving my innocence. i got lucky to have that help. there are hundreds of guys stuck in jail forever waiting for trials because they can't afford 15% of 1000 bucks! you wouldn't believe how many people go to court and get released immediately, because time served is already greater than the sentence.

after reading your further explanation of your views, i find that we are in agreement. there are some serious issues that should be addressed to insure fairness for everyone.
