I had a friend killed by a DD and he got 7 years for Involuntary Manslaughter, reduced to 3.5. That was in CA though.
However, the guy that hit my friend also was hit with 2 felonies. A third one is a minimum 25 years. That's for the rest of his life, don't know about NC law though.

^^not everyone has that same moral code. maybe his depression (or haunting as you call it) over the incident causes him to drink and drive again and kill someone else.
dude should spend some time in jail, even if it's a prison camp or something. taking a human life should have more serious repercussions.

the guy who killed my sister got 3 months and 3 years probation. his license was suspended for 12 months. no rescrictions on drinking, and he got another dui a year later. he died during another drinking/driving accident about 4 years ago.
for this guy the 400 hours of community service will be rough since his license is suspended for 3 years. he should go to jail for a period longer than 5 weekends, and while jail doesn't allow this guy to do anything productive like speaking at schools about what he did, i think it serves as a good taste for what he's facing should he ever fuck up again.] 8/21/2008 6:35:17 PM |

it was a question of being at the wrong place at the wrong time. Anyone could have killed that woman regardless if they had been drinking the night before...

i'm pretty sure i can tell when i shouldn't be driving, even the morning after i've been drinking. obviously this guy shouldn't have been driving, and the fact that he "thought he was ok" doesn't make it any better.

the only person in the wrong place at the wrong time was the woman on the bike. of course anyone could accidentally kill someone at any time, the point is that kid was still drunk when he hit her and should have been smart enough to realize that he should have stayed off the road.

I don't know how any sane person could even begin to think this is appropriate. This wasn't just a "mistake". He didn't just "screw up". He didn't just "make a bad choice".
He fucking killed someone. This innocent lady is dead, this fucking kid gets off with a slap on the wrist, and her family has to deal with that for the rest of their lives.
There is zero excuse for such a light sentence. Talking to kids in school about drinking? Community service? Is this some kind of fucking joke?
We live in a world where simple dope peddling will land you as much as 10 years or more, but killing someone out of completely conscious stupidity and irresponsibility gets you this? Let's get real. This kid should fucking rot in a cell, along with every other DUI murderer out there, but unfortunately the justice system fails yet again.

people are missing the fucking point of jail time. yeah it's punishment for the convict, you can isolate dangerous people from society, etc. but the most effective thing about jail should be the fact that it discourages future convicts from doing stupid shit. if he KNEW he was going to be ass-raped for years and kept in cramped quarters with little food (not the modern day pussy-jail bullshit), he might have reconsidered getting drunk all the fucking time, and we wouldn't have an innocent person dead right now. 8/21/2008 8:46:42 PM |

It sucks that a person died, but he obviously wasn't drinking and driving. He slept or tried to, and I'm pretty sure if I had to do 400 hours of community service and pay $10,000, and not be able to drive for 3 years, I would have a pretty shitty job and pretty much no ability to pay that money, and not be drinking at all much less ever drinking and driving. Jail would be good to scare him a little, but I don't think it's a good use of jail space since he most likely won't be doing anything that stupid for a long time. 8/21/2008 9:03:02 PM |

he had a DD and went home and slept it off, and tried to get up the next morning so that he wouldn't miss class but he didn't realize he was still over the limit by a little bit
