Youngsville, N.C. — A 12-year-old boy accidentally shot an 11-year-old boy with an AK-47 assault rifle on Friday afternoon, Franklin County Sheriff Pat Green said.

The 11-year-old, Giovann Lopez, was jumping on a trampoline to celebrate his birthday when he was shot once at 4842 U.S. Highway 401, outside of Youngsville, around 4:30 p.m.

The bullet went through Giovann's arm, grazed his arm and hit his other arm, taking out some flesh, Green said.

Giovanni was taken to WakeMed in Raleigh, and Green said the boy was expected to recover.

The 12-year-old boy was playing with the AK-47 and accidentally shot Giovanni, deputies said. The boys were neighbors and friends.

Deputies arrested the 12-year-old's father, Pablo Mendoza, 31, and charged him with misdemeanor failing to secure a weapon. He was released from jail on a written promise to appear in court.

Green said that the Franklin County district attorney will decide whether to charge the 12-year-old boy.

so did he really have an ak-47 or was it an sks? where's the discussion about possessing an automatic assault rifle? i thought you had to have a class 3 to own those?

Pablo obviously possessed the weapon legally or else there would have been other charges and he definitely wouldn't have been released on a "written promise to appear in court"

for fully auto yes, but most AK's I've seen here in the states are semi-auto, which doesn't require class 3.

I just wanted to make sure everyone knows that you can own semi-automatic AK-47s and that because they aren't fully automatic you don't need a class 3 permit.
