g/f mcPpnts was parked in the street (in right direction) outside of her house. her driveway is 1 car wide and 3 ppl there so she has to park there.

person across the street just backed into her car and left the scene. she called and cop is there now. they actually are getting that person to come back to the scene. cop says they're both at fault b/c she's parked in the street? wtf? says he may have to write her a ticket or something.


he trying to get out of writing a report?


should she go for the ticket and mark it up as an accident? we have no idea what to do. can't get ahold of our lawyer.

Pretty much comes down to if its legal to park on the street there or not

no, has to write the report. is there any signs that says she cant park in the street?

if so, then it would be just a parking ticket i would assume.

when you drive into a stationary object, you're at fault. he has to write a report, don't let him leave without doing so. the other person should also be totally at fault since its a hit & run now also. tell that hoe to press charges!

Ticket or not does not matter. She was not in the car at the time. Get a copy of the incident report and let the insurance companies battle it out

our attorney friend was home. he just got to the scene and is making sure it gets handled. <3 friends.

Yeah. And unless it is a no parking zone or something, she can park on the street in a residential area. Regardless, the accident would still be the other persons fault, even if she were illegally parked.

the cop tried to scare into thinking it was 1/2 her fault for her non-moving parking violation if it EVEN IS (no signs that says she can't).

we're writing a written formal complaint against the cop once this is over.


g/f works in the court house too and her boss will get all up on this. drama in her favor to ensue

Glad your attorney friend showed up. Sucks that you got a shitty cop.

In the future for you and everyone else, take lots of pictures of the scene and damage. It never hurts to have evidence.

I was under the impression that if a moving car hit a stationary one the moving one was at fault.

^^ if there is a person in the stationary car who is drunk, it is the fault of the stationary car. go figure

yea, make sure you take lots of pictures of everything. Make sure you take pictures of the lot. If where you live, there are no signs that say "No parking in street" or the like, then it is legal for her to park in the street and that cop is a dumbass. Any good lawyer would be able to get out of that one easily. The person that hit the stationary car is definitely at fault. This cop saying that he doesn't want to write a report is just lazy

everyone is gone now and here's the semi-skinny:

cop did formal exchange of information (yet didn't get other lady's insurance - wrote g/f's twice)

cop still thought it was both of their faults since she was "parked illegally" even though there are no signs

cop let the lady say she thought she hit a trash can and didn't write her for hit&run.



20 pictures were taken. 20 more during the daytime in the morning.

it's hard to get a hit and run conviction if the other person doesn't admit to it

the cop's determination of fault isn't the end-all be-all

this shit makes me so mad. i'm gonna come back tomorrow. more beer needed i already had too many beers to drive to the scene or i'd prob be in jail now

reminds me of a few years ago...visiting a friend at UNCC, on her back porch smoking, and we see her roommate pulling up into a parking spot, right next to mine. she makes a few maneuvers, hits my bumper, then turns around and parks on the other side of the parking lot. we kinda laugh it off, and wait for her to get to the apartment.

so she walks in, and we play it like everything was cool. then we say, "so how about that car you just hit?" she responds with "oh my god, did ya'll see that? don't tell anyone!"

the look on her face when i introduced myself was priceless. "hi. my name is mike. that car you hit is mine."

other than the fact that she totally did the bitch move by not fessing up to it, i kinda felt bad because it was like $400 for the fix. but at least she got the benefit of not having insurance getting involved.
