the article says the person shot was one of the guys breaking in and this sean kid was a resident

it doesnt say the name of the dead person

that is sad. TWW has no sympathy, only mockery, you could get cancer and they'd post a photoshop of you bald with the word FAIL pasted at the bottom.

Tons of people I knew in high school have already died because of drugs. You get kinda numb to it after awhile.

the sad part is that the police had no right to search their house for drugs.

i understand that it probably has something to do with the situation, but it really has nothing to do with the act of protecting your house and life from an intruder

a good lawyer gets that dismissed

why does everyone assume that she's saying her friend is dead? jail is sad, and i'd imagine that killing someone isn't exactly happy...

All the article asserts is that investigators found drugs on the premise. If the drugs or paraphernalia were out in the open when the cops responded, it's doubtful a lawyer will get that dismissed.

I also wasn't really being serious. I don't know, he clearly was looking for sympathy for someone though. I was just reminding him that this is a bad place to look.

I'm in law school at UNC. My brother is a lawyer, and my girlfriend is as well.

Its called the plain sight rule.

And although i agree with you jackleg, that a smart person would hide drugs, you would be amazed at the foolish shit people do.

i dont doubt your credentials or experience. i know all about search and seizure / plain sight / etc...

i was just referring to the part where it's implied that the guys had the presence of mind to respond quickly enough to kill an intruder, but just forgot to hide their pot.

(especially because that much pot never sits out in plain sight anyways)

so i guess i'm saying that i agree that if its in plain sight, its fair game...

but when we talk about hypotheticals, we should use the most likely situations... and in the majority of situations like that, an amount of drugs large enough to get a PWISD charge would be hidden, even if they werent expecting cops

and ESPECIALLY if they knew cops would be there soon.

You can probably charge someone with PWISD even if there wasn't a shitload of weed out. Scales or pieces can be enough, though I'm not sure how either of those establish intent to sell. I've heard of it happening. I agree with Jackleg though, no one is going to keep more than an ounce in plain sight, especially when you know the cops are coming. They must have done a search.

I dunno, they may escape a drug charge. Comma however. If they purchased the guns through a non-private party FFL dealer, they had to indicate that they are not, nor have ever been, a user of illegal drugs. So firearms laws may still apply here.

But I suppose that depends on what happens to the drug evidence.

^^My point is that they may have found weed, but used scales/baggies/pieces/whatever to establish "intent" to sell, rather than just plain old possession.
