for going 76 in a 55. Can i get a prayer for judgement? i've been driving for 5 years now with no offenses and nothing else on my record. I've never been to court so i don't really know what to do about getting one. Also what are the chances the cop would show up? i got the ticket on highway 64 almost in chatham county.

go talk to the DA. then ask for a continuance if he doesnt offer you something nice. see if he will at least knock it down to 9 over, that wont affect your insurance.

yep... when they call your name yell out "OPEN!", then ask the DA to drop it to 9 over, if he says no tell him "I'd like to continue"... you can try this up to 3 times before they mark it last and you have to plea on your next appearance.if you have mega big balls you can look around and see if your officer is there and then call out your plea when you hear your name if he's not. you can also ask the DA if the officer is in today before requesting a continuance, if he says no you'll want to plea. this'll earn you a state continuance, as they can't proceed with their case without their witness. 3 of these and it usually gets marked "last for state" and dropped on the next appearance if they don't have a witness. but keep in mind that he may just be running late or out of the court room, and lawyers have a lot more flexibility with evading the actual trial if the cop shows up, so...then, you should get a real lawyer if it matters, because they can grab your case off the docket and disappear into another court room if your officer is there, and sit around demanding to be tried if he's not.. the DA will also probably negotiate with him a little more seriously. but don't think the lawyer's going to do much more than play the system himself, he's definitely not gonna stand up there and argue that you're innocent 9 over is 0 insurance points, so it doesn't affect your insurance rates. you'll get cost of court ($150 now?) and a small fine.[Edited on May 28, 2009 at 7:11 AM. this thread is funny - I love how everyone says, "Hire a lawyer!"What the hell can a lawyer do that you can't? I mean seriously, you were clocked with a radar lock (most likely) and a signed sworn statement by a police officer. Furthermore, you signed the ticket agreeing to the terms. Lawyers just exploit peoples fears, they're useless unless the ticket was received out of state where you can't appear in court for logistical reasons.Honestly, show up in a nice suit, prepare a 30 second speech AGREEING with the ticket (don't ever say "I wasn't going that fast" or disagree, you'll pay big time), apologize, state your past driving record, and offer to do (15 hours?) of community service, and mail in a signed time sheet (or show back up if they prefer) documenting it. It'll suck, but your insurance will jump for 3 years...

^and for some credibility, I got a triple digit ticket DISMISSED for this approach (although 25 hrs of community service I offered). Not court costs, no 9 over crap, no fines....they were so impressed the DA dismissed it fully. Oh Yea, try to avoid the judge if possible, they can't stretch the rules like the DA can.

If it's in Wake County then I would see if they'll reduce it. I was going 80 in a 65 not too long ago but had a clean record and they reduced it, and I think it was $121 total. If the DA will not reduce it, get a lawyer then and have it continued.

i've been to court half a dozen times in the past 5 years...i admit that i have a lead foot, but that's changed since i got a tiny-engined saturn anyway, i've never had a lawyer and only ONE out of those six tickets has ever resulted in me paying anything (and then it was only court costs plus a $25 fine after it was reduced to 4 over)i've yet to find a good reason to pay a lawyer for what i can do myself...i hope that never changes

Hmmm... why hire a lawyer? Because for a couple hundred bucks I don't have to drive to the courthouse where I got my ticket (often out of town). I don't have to worry about presenting a case or whether or not some cop is going to show up. I don't have to put on a suit, act apologetic, make up lame excuses, have a 30 second spiel or heaven forbid do 25 hours of community service like some of you have suggested. I make 1 phone call, send them a check, and get my 95 in a 65 reduced to "improper muffler." I'd say it's easily worth that. This is relevant to my interests. I got 70 in a 55 this past weekend, but I have a prior 68/55 three years ago (reduced to 9 over).What's the difference between the DA and the judge? How does one talk to just the DA? Can you just roll up whenever and talk to him?

^^^^ ah, to each their own, i suppose...only one was out of town, so the drive was negligible...most were during school, so it's not like i had to take off work...i've never worn a suit to court, usually just khakis and a button-up shirt with a tie...i also think it's FUN to go to court...i enjoy the excitement of seeing how much i can get away with also, $250 x 6 = $1500 which is a lot of money for what is less than 8 hours of my life...i don't make $190/hour, so that's a lot of money for being lazy*shrug*[Edited on May 28, 2009 at 9:09 AM.
