I don't speed but I don't like being surprised by the po-po's presence either. I generally feel better when they're not around.

I generally drive close to the speed limit, but I still get nervous around cops. I just don't want to be the one driver that officer decided to pull for doing a little over just because he's bored or needs to fill a quota.

Cops don't have quotas... they have performance goals. So instead of, "Officer you didn't give 300 tickets this month, therefore I'm assigning you to crosswalk duty at the school for the blind." It's actually, "Officer you only gave 298 tickets this month, you are not meeting performance expectations, therefore I'm assigning to the improvement force (aka crosswalk duty at the school for the blind)."

At least one officer who had a distinguished arrest record was given low performance evaluations solely for failing to write enough traffic tickets, Ms. Weinstock wrote.

"The city shall cease and desist from maintaining a vehicular ticket quota," Ms. Weinstock wrote, referring to tickets for illegal parking, standing and stopping. She also ruled that the Police Department must revise poor performance evaluations on request if they reflect an officer's failure to meet the ticket quota. She did not rule on whether there was a quota for moving violations.

The finding, which comes in response to a grievance filed by the police officers' union in May 2004, would appear to be the first formal ruling on an issue that has been bitterly contested for years. Union officials have long said that a quota system existed, and that officers who failed to meet the goals faced transfer, loss of overtime, or unfavorable evaluations.

In the 75th Precinct, the union accused the Police Department of setting quotas for parking tickets, moving violations, "quality of life" summonses (for offenses like turnstile jumping) and arrests, according to the arbitrator's report.

"Such quotas put the cops under pressure to write summonses when the violations don't exist," said Al O'Leary, a spokesman for the union, the Patrolmen's Benevolent Association. "It takes discretion away from the police officer."

The Police Department said that commanders can set "productivity goals" but not specific quotas. Paul J. Browne, the department's chief spokesman, said that the arbitrator's involvement began with the transfer or reassignment of 13 officers in the 75th Precinct because of overall poor performance. "The arbitrator concluded that none of the officers were transferred or reassigned based solely on their lack of summons activity," he said.

But illustrating how the issue has become a semantic wrestling match, he added that after the arbitrator's ruling, the precinct's command was instructed not to establish specific numeric quotas for summonses linked to performance evaluations.

Mr. Browne added that the ruling did not prevent commanders from setting productivity goals, including summonses. He also said that officers who are responsible for issuing summonses would continue to be evaluated on their performance.

The arbitrator tried to settle the question, saying that the 75th Precinct did have a quota system, citing evidence including a directive from the commander, Deputy Chief Michael Marino, that tied performance evaluations to numbers of summonses and arrests.

She said that one officer, David Velez, who was singled out by at least one of his supervisors for his high number of felony arrests, was nonetheless given low marks on performance evaluations for not writing traffic and "quality of life" summonses, the arbitrator found. Officers with low marks on evaluations are unlikely to be selected for specialized units or details, and therefore, poor evaluations should be considered penalties, a violation of the state's labor law, she wrote.

The issue of ticket quantities came up during a City Council hearing in June regarding complaints that the police were becoming too aggressive in writing parking citations. The department said it had no quotas, but did have "expectations" for the number of tickets each parking agent should be writing. "

the faster you go reduces your reaction time. if you are doing 10-15 over, which lets face it most of you that frown apon speeding tickets do, a ticket is just away of avoiding a carless wreck. so infact they are doing there job correctly. if no one sped, the % of wrecks would be way less.

Yup, there are some cops who wouldn't stop a car unless it plowed into them drunk. Not everyone is radar certified so you can't just scratch out speeding tickets.
