I don't understand why there is a question of him being charged here. The burglar was an intruder in his private residence. The student felt as if his life was in danger. This was obviously a case of self defense. What was he supposed to do here? What is the actual law regarding this situation? Are you just supposed to lock your bedroom door and hide under the bed until the police come?

while quite possibly it's best to get away from the scene/intruder, while still remaining armed, I think it should be a person's choice (legally) to confront an intruder and take the appropriate actions then, as in protection of life AND property. With laws written how they are this isn't situation isn't always legal...

to be a robbery, the property must be taken from the owner/possessor by force. sounds like to me we have ourselves a felony B&E and thereby a felony larceny, not a common law robbery

but it is a common misconception

and its also likely that what most people consider a "burglary" is just a larceny
to be a burglary, it has to be at night and there are numerous other elements that must be met to consider it an actual burglary. most stolen property is obtained through a larceny.
