I don't understand why there is a question of him being charged here. The burglar was an intruder in his private residence. The student felt as if his life was in danger. This was obviously a case of self defense. What was he supposed to do here? What is the actual law regarding this situation? Are you just supposed to lock your bedroom door and hide under the bed until the police come?

negative my friendbut it is a common misconceptionand its also likely that what most people consider a "burglary" is just a larcenyto be a burglary, it has to be at night and there are numerous other elements that must be met to consider it an actual burglary. most stolen property is obtained through a larceny.
