She told me she was and that she didn't have a drivers license so she didn't want to file a police report. TOO BAD.
There is a 99.9% chance that they won't give me painkillers even if they did I need them. My back has been killing me for the past month so much that I can't get out of bed(pinched nerve).

Since the seatbelt didn't work and the airbag didn't deploy, I bet you could sue the mess out of the manufacturer. But I'm sure something would go horribly wrong with that, too.

It's a 1993 Honda so half the stuff on it doesn't work. I don't know if they would do anything about it since it's so old. It passed inspection but they didn't check stuff like that.

If you had it inspected, I'm pretty sure you can definitely sue.
Seat belts are not supposed to just stop working cause a car is old.

I was in too much shock at the time to say much but the basics to the officers. I was more concerned about her two children that were in the car at the time than she was...wtf.
Good thinking though. I will call the police dept tom and make note of the seat belt/air bag failure.

No, I didn't call the cops. We were blocking the road since her car was literally stuck to mine and we couldn't move. The cops came on their own.

Yes she should have this, you can't get a policy in NC without it. The minimum is $30k bodily injury, $60k bodily injury for multiple passengers, and $25k property damage. So if your car was worth less than $25k and you sustained less than $30k in hospital/doctor bills then you're fully covered. You also mentioned that you have been having back pain before the wreck so I'd consult a lawyer. Typically the uninsured/underinsured coverage would pay for hit-run bodily injury to you (whether you are driving or a pedestrian/side of the road/etc) but not the property damage (your car). Other than collision/comprehensive would cover the damage to your car in a hit-run situation I believe.
It's all spelled out in your policy contract in plain english.
EDIT: I don't really know what full coverage means but you'd file the claim just like you'd file any other claim. (I also assume you'd get a police report for a hit and run)

I may be mistaken, but I was under the impression that if you don't get a police report you can not file an insurance claim (for an accident). Is that the case? I've always heard it mentioned when people decide to not call the cops for a fender bender that its on honesty policy from there on

This is wrong. I was the victim of a hit and run in October, and after I called the police on the spot and filed a hit and run report, I only had to pay a $100 deductible (repayed when they get the money from the uninsured... which never happened, don't be surprised if you never see your $100 again) and my car was fully taken care of.
There's no police report? If you drove away from the scene, then you're shit out of luck. You should have called the cops. I don't think you have any course of action at all at this point.

^maybe your insurance policy is different. Mine specifically states:

My OTC coverage states it will cover "Malicious mischief or vandalism". Also uninsured coverage typically does not have a deductible that I am aware of it (at least on my policy there is no deductible).

I think ThePeter was posting a hypothetical, it sounds like RachelMarie got a police report. In any event, the police are not required to file a report if the damage is below a certain threshold (it's somewhere under $2k) and there is no bodily injury at the time. That is why insurance companies used to encourage drivers to carry a disposable camera in their car (before camera phones were pretty much standard). You are also required by law to provide your insurance info in a fender bender. They can always give you false info but that is why you take pictures and write down their license plate # (and even take a picture of it) in a situation like that.
I've been rear-ended by a guy and was lucky enough for a cop to witness it. He told me he wasn't going to file a report or write the other guy a ticket but gave me his number and told me to call if I had trouble getting paid from the insurance company (or the guy, the guy really wanted to pay it out of pocket and not involve his insurance company).

Maybe that's the difference? I was able to get a police report filed and find the girl who hit me. It was a hit and run, though, which is a low class felony. It seems like, from Rachel's post, that the Mexican lady hit her, didn't want to file a report, and so they both left the scene and Rachel filed one later? That doesn't make a whole lot of sense though.
As long as RachelMarie can prove the Mexican lady hit her, and that she has no insurance, she should have no problem getting the car and herself taken care of. She needs to call her insurance company and figure it out, though.12/10/2010 8:47:59 AM |
