This is a clause in all newegg sweepstakes. I do not know how they can enforce this or what it really means, but it sure scares me away from entering anything!
Quote : | "LICENSES AND REPRESENTATIONS: By submitting an Entry, you hereby grant Sponsors, their licensees, distributor, agents, representatives and other authorized users, a perpetual, exclusive, irrevocable, royalty-free, sub-licensable, and transferrable (in whole or in part) license throughout the universe under all copyright, trademark, patent, trade secrets, moral and privacy and publicity rights and other intellectual property rights you own or control to use, reproduce, transmit, display, exhibit, distribute, index, comment on, modify, create derivative works, perform, and otherwise exploit such Entry, in whole or in part, in all media formats now known or hereafter devised (including on Sponsors’ sites, on third party websites, on broadcast and cable networks and stations, on broadband and wireless platforms, and on physical media) for any and all purposes including entertainment, news, advertising, promotional, marketing, publicity, trade or commercial purposes, all without further notice to you, with or without attribution, and without the requirement of any permission from or payment to you or to any other person or entity. By submitting an Entry, you represent and warrant that you own or have the necessary rights, licenses, consents and permissions, without the need for any permission from or payment to any other person or entity, to exploit all elements of the Entry in all manners contemplated by these Official Rules. I read it as basically...
Quote : | " You grant us and all associated with us (including any "authorized user") the exclusive rights to all of your intellectual property throughout all of time and space and in any media in which it was created. " |

Surely that only applies to photos and such you submit as part of an entry. Otherwise there's no way it's enforceable but.... you definitely have my attention. 8/15/2011 9:11:42 AM |

There is nothing that you are submitting as part of the sweepstakes entry...other than your life? 8/15/2011 9:40:49 AM |

^^Nothing but your information (life) for this entry, but they have done photo entries in the past. I think it's saying they can use your information, or in the case of programs that require work the work itself, for anything because they own it. I don't like the way it's worded at all, which is why I'm bumping for input haha 8/15/2011 11:45:42 AM |

This kind of thing is on "sweepstakes" entrance forms all the time - the fine print, if you will. Particularly those little slips of paper you fill out and drop in a box to win a cruise/car/motorcycle etc.
There's always a disclaimer saying something along the lines of "The info you provide is now OURS, and we can do with it whatever we want!"
All this really means? You're going to get solicited when they sell your information to a third-party. Prepare yourself for some telemarketing calls, at least in terms of other sweepstakes. Not sure what the NewEgg sweepstakes entails, precisely. 8/15/2011 12:55:40 PM |
