Many of the articles about Samir go to extremes to point out how people at his mosque tried to discourage him from his anit-American views.

Here's a question: Why WOULDN'T muslims be pissed at America?

I mean, I don't really have a dog in the fight, but I can understand their frustration. There is ZERO chance of ever using domestic political means to end the U.S.'s persecution and slaughter of muslims abroad. Is it just that American muslims have a good life, a nice car and enough to lose to prefer to keep their head down and hope this all blows over?

The guy was a propagandist and recruiter for a militant group openly at war with the United States, particularly its citizens. No laws, domestic or international, restrict a country from neutralizing such threats when they have the chance.

Not to mention, a person interested in surrendering and/or appealing his designation as an enemy combatant does not do so by hiding out in the remote tribal villages of southern Yemen while continuing to behave exactly like an enemy combatant.

It's not a criminal matter. It's a military matter covered by the Authorization for Use of Military Force.

The Fifth Amendment protects the due process in criminal matters of all persons, not just citizens. If we were to do it your way, we would have to have grand juries indict every single member of al Qaeda, the Taliban, and every other militant group that opts not to wear uniforms, from its leaders down to its foot soldiers, before taking deadly action against them.
